REGULAR MEETING <br />NOVEMBER 12, 2007 <br />SECTION III. The Common Council of the City of South Bend, Indiana, hereby finds <br />that: <br />The proposed use will not be injurious to the public health, safety, comfort, <br />community moral standards, convenience or general welfare; <br />2. The proposed use will not injure or adversely affect the use of the adjacent <br />area or property values therein; <br />The proposed use will be consistent with the character of the district in which <br />it is located and the land uses authorized therein; <br />4. The proposed use is compatible with the recommendations of the City of <br />South Bend Comprehensive plan; <br />SECTION IV. Approval is subject to the Petitioner complying with the reasonable <br />conditions established by the Board of Zoning Appeals which are on file in the office of <br />the City Clerk. <br />SECTION V. The Resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />s/Timothy A. Rouse <br />Member of the Common Council <br />Councilmember Al "Buddy" Kirsits, Chairperson, Zoning and Annexation Committee, <br />reported that this Committee held a public hearing on this bill this afternoon and voted to <br />send it to the full Council with no recommendation. <br />Mr. Chuck Bulot, Interim Director, St. Joseph County Building Department, 125 S. <br />Lafayette Blvd., Suite 100, South Bend, Indiana, presented the report from the Board of <br />Zoning Appeals. <br />Mr. Bulot advised that the petitioners are seeking a special exception to allow a single <br />family residence in a "1VIF1" District. He noted that the Board of Zoning Appeals held a <br />public hearing on October 18, 2007 and sends this bill to the Common Council with a <br />favorable recommendation. <br />Ms. Charlotte Sobel, Director of Development & Special Projects, South Bend Heritage <br />Foundation, 803 Lincolnway West, South Bend, Indiana, made the presentation for this <br />bill. <br />Ms. Sobel advised that this bill would allow for the construction of a new, market-rate <br />single-family home in an area zoned "1VIF 1". She advised that Northeast Revitalization <br />Organization (NNRO) staffed by South Bend Heritage Foundation (SBHF), purchased <br />this property from the University of Notre Dame in 2004. At that time, the property was <br />the site of a dilapidated single-family home that was uninhabited and in extreme <br />disrepair. The property was demolished to rid the Northeast neighborhood of an eyesore. <br />In August of 2007, the NNRO sold the property to Custom Homes by Petty. Custom <br />Homes by Petty purchased the property to build a new market-rate single-family home. <br />Ms. Sobel stated that the NNRO Board of Directors fully supports this proposal. Custom <br />Homes by Petty then went to the South Bend/St. Joseph County Building Department to <br />pull a building permit for 813 South Bend Avenue. The issuance of a building permit <br />was denied due to the current zoning of the property, "MF 1". The NNRO, SBHF, as well <br />as Custom Homes by Petty, assumed the property was zoned SF2 as that had been the use <br />of the property for over 50 years. Ms. Sobel urged the Council's favorable consideration <br />of this bill. <br />10 <br />
