Are you suggesting .... <br />Ms. Greene: Let me just clarify. First of all, <br />specifically, the language is "confirmation <br />that the covenant against any use which <br />prohibits the issuance of an alcoholic <br />beverage permit, pursuant to the statute does <br />not prohibit his ownership and use of the <br />building." I think that's a legal conclusion, <br />but, if the question is whether or not the <br />Commission is trying to stay a proposed sale, <br />it really is business decisions based upon the <br />use the property owner intends to make of <br />the property. They make a determination <br />knowing the restrictions and covenants that <br />are in place as to whether or not their use <br />would be a violation of that. <br />Mr. King: I understand that. But you've <br />made quite a point of the reasons why those <br />instructions are in the deed. There's mention <br />of this in the proposed purchaser's attorney's <br />letter. You are not asking us to take any <br />action on that, nevertheless it seems an <br />important point that we should note as we <br />authorize you to take these other actions that <br />22 <br />
