South Bend Redevelopment Commission <br />Regular Meeting -July 21, 2006 <br />6. NEW BUSINESS (CONT.) <br />C. South Bend Central Development Area <br />continue ... <br />Commission grappled with this issue recently <br />when it was involved in the relocation of the <br />School Corporation administration building. <br />The School Corporation administration <br />services have been relocated to the former <br />Century Building. The concern at that time <br />was whether that property (i.e. the former <br />Century Building) would become or could be <br />considered a school such that it would <br />prohibit liquor licenses from being issued <br />within 200 feet of the building. If so, those <br />properties located within 200 feet of the new <br />School Administration Building would <br />include the new Gameday project and other <br />areas the Commission has earmarked as <br />entertainment areas. In analyzing the School <br />Corporation project, Legal Counsel was <br />satisfied that the new School Administration <br />Building would not be considered a "school" <br />such that the ABC would be prohibited from <br />issuing a license. It is an administrative <br />facility and, therefore, the Commission's <br />interests related to its planned entertainment <br />district were not impaired by the School <br />Administration project.. <br />With respect to this purchaser of the State <br />Theater, Legal Counsel has a letter from Mr. <br />Jim Masters, an attorney in South Bend, that <br />references the prospective purchaser of the <br />State Theatre. The letter is dated July 19, <br />2006. Issue #2 in the letter is "confirmation <br />that the covenant against any use which <br />prohibits the issuance of an alcoholic <br />beverage permit, pursuant to I . C. 7.1-3 -21-11 <br />does not prohibit my client's ownership and <br />20 <br />
