,~ <br />x."'. <br />~~ ~ ; , ' ~ Public Works and Property Vacation Committee <br />2007 Sou#h Benc[ Gommon Council <br />The August 27, 2007 meeting of the Public Works and Property Vacation Committee of <br />the South Bend Common Council was called to order by its Chairperson, Council <br />Member David Varner at 4:06 p.m. in the Council's Informal Meeting Room. <br />Persons in attendance included Council Members Kelly, Varner, Pfeifer, Kirsits, Dieter, <br />Kuspa, Rouse, and Puzzello;, Mayor Stephen Luecke, Public Works Director Gary Gilot, <br />Bernie Feeney, Mrs. Kopola, City Clerk John Voorde, George Herendeen, Mark <br />Dobson, Robert Mathis, Jamie Loo of the South Bend Tribune and Kathleen Cekanski- <br />Farrand, Council Attorney. <br />Dr. Varner noted that the Committee members include Council Members Pfeifer, Dieter, <br />Kelly and himself; slang with J. Edward Talley as the Citizen Member. <br />Dr. Varner then called for a presentation on Substitute Bill No. 43-07 requesting a <br />vacation of the first eastlwest alley north of Nnrthside Boulevard. <br />Substitute Bill No. 43-07: Re nest to Vacate Ist EIW Alle north of Northside <br />Boulevard <br />J. Bernard Feeney of Lang, Feeney & Associates, Inc., with offices located at 795 South <br />Michigan Street in downtown South Bend made the formal presentation. He noted that <br />the purpose of the vacation is to eliminate the alley which access and divides an <br />existing parking lat. The parking lot has access from 21St Street. Mr. Feeney provided a <br />2-page handout depicting maps of the area in question (copy attached). He indicated <br />that his client would provide an access agreement with the Fire Department. <br />Public Works Director Gary Gilot reviewed the areas of concern highlighted in the <br />Board of Public Works letter of June 11, 2007 (copy attached). He noted that based <br />on the information provided by Mr. Feeney all three (3) items have been addressed. <br />No one from the public spoke in favor or in opposition to the Bill. <br />Council Member Pfeifer made a motion, seconded by Council Member Dieter that <br />Substitute Bill No. 43-07 be recommended favorably to Council. The motion passed. <br />Dr. Vamer then called for a presentation an Bill No. 49-07 requesting a vacation of a <br />portion of Brick Raad right-of-way in German Township. <br />
