' <br />Q-;-,; W"M <br />=M-M <br />I <br />- =7- <br />Information and data on a User obtained from „ reports, surveys,. <br />weastewaterddischarge rpe Qit a applications, individual wastewater discharge <br />and from the Director's inspection and <br />sampling activities shall be available to the public without restriction <br />unless the User s ecifieail requests, and is able to demonstrate to the <br />satisfaction of the Director, that the release of such information would <br />divulge information, processes, or methods 'of production entitled to <br />rotection as trade secrets under the Indiana Access to Public Records Act <br />I.C. 5- 14 -3 -4 a 4 . Any such request must be asserted at the time of <br />submission of the information or data. When requested and demonstrated <br />by the User furnishing. a _report that such information should be held <br />confidential the vortions of a report which might disclose trade secrets or <br />secret processes shall not be made available for inspection by the public, <br />but shall be made available immediately upon request to overnmental <br />agencies for uses related to the NPDES progEam,or retreatment ro ram <br />and in enforcement proceedings involving the person furnishing-!he report. <br />Wastewater constituents and characteristics and other effluent data as <br />defined at 40 CFR 2.302 shall not be recognized as confidential <br />information and shall be available to the publicwithout restriction. <br />(OLY) Board of Works powers. If any waters or wastes are discharged, or are <br />proposed to be discharged, to the public sewers, which waters contain the <br />substances or possess the characteristics enumerated in this aA_rticle, and which in <br />the judgment of the Board may have a deleterious effect upon the sewage works, <br />processes, equipment or receiving waters, or otherwise create a hazard to life or <br />constitute a public nuisance, the Board may do any of the following_ <br />( 1) Require new industFies users or dies users with significant <br />increase in discharges to submit information on waste water characteristics <br />and obtain prior approval for discharges.
