REGULAR MEETINGNOVEMBER 14, 2005 <br />RESOLUTIONS <br />BILL NO. 05-129 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> APPROVING A PETITION OF THE SOUTH <br /> BEND BOARD OF ZONING APPEALS FOR <br /> THE PROPERTY LOCATED AT 746 DIAMOND <br /> AVENUE, SOUTH BEND, INDIANA <br />Councilmember Kuspa, Chairperson, Zoning & Annexation Committee, reported that this <br />committee held a Public Hearing on this bill this afternoon and sends this bill to the full <br />Council with no recommendation. <br />Mr. Donald Fozo, Building Commissioner, South Bend and St. Joseph County, Indiana, <br />gave the Board of Zoning Appeals report. <br />Mr. Fozo advised that on October 20, 2005, the Board of Zoning Appeals met regarding <br />this bill. Mr. Fozo further noted that this bill is sent to the Common Council with an <br />unfavorable recommendation by a vote of 3-1. <br />Ms. Maria Munguia, 746 Diamond Avenue, South Bend, Indiana, made the presentation <br />for this bill, with the assistance of an interpreter. <br />Ms. Munguia advised that she is seeking a special exception at 746 Diamond Avenue to <br />allow for an accessory living space to be constructed above the current detached garage. <br />This space will be occupied by her mother-in-law. <br />A Public Hearing was held on the Resolution at this time. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this Resolution, Councilmember Dieter made a motion to defeat this <br />Resolution. Councilmember Puzzello seconded the motion which carried and the <br />Resolution was defeated by a roll call vote of eight (8) ayes. <br />BILL NO. 05-130 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> APPROVING A PETITION OF THE SOUTH <br /> BEND INDIANA, APPROVING A PETITION OF <br /> THE SOUTH BEND BOARD OF ZONING <br /> APPEALS FOR THE PROPERTY LOCATED AT <br /> 1126 W. WASHINGTON STREET, SOUTH <br /> BEND, INDIANA <br />Councilmember Dieter made a motion to continue this bill until the November 28, 2005 <br />meeting of the Council. Councilmember Puzzello seconded the motion, which carried by <br />a voice vote of eight (8) ayes. <br />RESOLUTION NO. 3533-05 A RESOLUTION CONFIRMING THE <br /> ADOPTION OF A DECLARATORY <br /> RESOLUTION DESIGNATING CERTAIN <br /> AREAS WITHIN THE CITY OF SOUTH BEND, <br /> INDIANA, COMMONLY KNOWN AS 301 EAST <br /> SAMPLE STREET TO BE AN ECONOMIC <br /> REVITALIZATION AREA FOR PURPOSES OF <br /> A FIVE (5) YEAR PERSONAL PROPERTY TAX <br /> ABATMENT FOR MOSSBERG & COMPANY <br /> INC. <br />33 <br /> <br />
