REGULAR MEETINGMAY 23, 2005 <br />hearing the staff recommends that this petition be sent to the Common Council with a <br />favorable recommendation. <br />Mr. Michael Danch, President, Danch, Harner & Associates, 2422 Viridian Drive, Suite <br />201, South Bend, Indiana, made the presentation for this bill on behalf of the petitioner Jo <br />Ann Nucci. <br />Mr. Danch advised that the petitioner is requesting the approval of an Annexation and <br />Rezoning for her property at 52520 Portage Road, South Bend, Indiana. This rezoning is <br />to allow for the construction of a Small Commercial Center facility with a drive-up <br />window. This project site is located on the East side of Portage Road across from the <br />Teachers Credit Union site. The proposed small commercial center facility will be <br />compatible with the other commercial uses existing along this portion of Portage Road. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Varner made a motion for favorable <br />recommendation to full Council concerning this bill and set it for third reading on June <br />13, 2005. Councilmember Kuspa seconded the motion which carried by a voice vote of <br />nine (9) ayes. <br />BILL NO. 26-05 PUBLIC HEARING ON A BILL TO VACATE <br /> THE FOLLOWING DESCRIBED PROPERTY: <br /> THE RIGHT-OF-WAY BEGINNING AT THE <br /> SOUTHEAST CORNER OF LOT 166 OF <br /> UNIVERSITY HEIGHTS, A SUBDIVISION IN <br /> THE CITY OF SOUTH BEND; THENCE SOUTH <br /> 9.00 FEET ALONG THE PROJECTED EAST <br /> LINE OF SAID LOT; THENCE WEST <br /> PARALLEL TO THE SOUTH LINE OF SAID <br /> LOT 63.00 FEET; THENCE NORTH PARALLEL <br /> TO THE PROJECTED EAST LINE OF SAID LOT <br /> 9.00 FEET TO THE SOUTH LINE OF SAID LOT; <br /> THENCE EAST 63.00 FEET ALONG SAID <br /> SOUTH LINE TO THE POINT OF BEGINNING <br />Councilmember Varner, Chairperson, Pubic Works and Property Vacation Committee, <br />reported that this committee held a Pubic Hearing on this bill this afternoon and voted to <br />send it to the full Council with a favorable recommendation. <br />Doug Marsh, 200 Facilities Building, Notre Dame, Indiana, made the presentation for this <br />bill. <br />Mr. Marsh advised that the right-of-way to be vacated is located along the southern <br />boundary of Lot #167, and consists of 566 square feet, and is to permit the construction <br />of a limestone pier as a part of the University of Notre Dame’s new campus gateway. <br />This being the time heretofore set for Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />Ms. Kate Adams, 813 E. Angela Boulevard, South Bend, Indiana, questioned how much <br />if any of the intersection would be taken away? <br />Mr. Marsh stated that there would be no change to size of the intersection. <br />There being no one else present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Kuspa made a motion for favorable <br />recommendation to full Council concerning this bill.
