REGULAR MEETING FEBRUARY 27, 2006 <br />In rebuttal, Mr. Feeney stated that the petitioner has addressed the traffic curb cut onto <br />Pyle Avenue and that would be the safest ingress/egress into the property. Mr. Feeney <br />stated that the drainage issue is the responsibility of the petitioner and would be a part of <br />the final site plan. <br />Councilmember Kirsits stated that the traffic at that intersection is terrible. This is a good <br />project however, unfortunately it is a bad location. Mr. Kirsits advised that this lot is the <br />location of a terrible house tragedy several years ago and if it were not for this, the lot in <br />question would still have a home on it. He stated that he would be voting against this <br />bill. <br />Councilmember Puzzello stated that this project goes much too far into the residential <br />neighborhood. The traffic on Edison is much to heavy and congested to support another <br />business. She stated that she would be voting against this bill. <br />Councilmember Rouse advised that his concerns are also with the congested area of <br />Edison Rd. and Pyle Avenue. He suggested no left turns in that area. <br />Councilmember Dieter made a motion for unfavorable recommendation to full Council <br />concerning this bill as substituted. Councilmember Puzzello seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br />BILL NO. 93-05 PUBLIC HEARING ON A BILL <br /> AMENDING THE ZONING ORDINANCE <br /> FOR PROPERTY LOCATED AT 505 E. <br /> IRELAND ROAD, 4412 FELLOWS <br /> STREET AND 4422 FELLOWS STREET, <br /> COUNCILMANIC DISTRICT NO. 5, IN <br /> THE CITY OF SOUTH BEND, INDIANA <br />Councilmember Kuspa, Chairperson, Zoning and Annexation Committee, reported that <br />this committee met on this bill this afternoon and voted to send it to the full Council with <br />a favorable recommendation. <br />Mr. P.J. Thuringer, Staff Planner, Area Plan Commission, 1823 N. Adams, South Bend, <br />Indiana, presented the report from the Commission. <br />Mr. Thuringer advised that the petitioner is requesting a zone change from “SF1” Single <br />Family and is requested to be changed to “O” for Office District as proposed for <br />development along the Ireland Road Corridor. Mr. Thuringer stated that this is a <br />substitute bill that originally petitioned for a change from the Single Family (SF1) to CB <br />Commercial Development. The staff recommended that this rezoning would conflict <br />with Goal 2, Objective B of the Comprehensive Policy Plan. The rezoning allows high <br />intensity commercial uses that would be in conflict with the northern established single- <br />family neighborhood. The staff further recommended that this residential neighborhood <br />would be better protected by either leaving the property single-family or zoning it to one <br />of the office zoning districts. Mr. Thuringer further noted that the Commission met on <br />the original petition on Tuesday, January 17, 2006 and sent it to the Common Council <br />with no recommendation. <br />Mr. Bill Schalliol, Redevelopment Department, 1200 County-City Building, South Bend, <br />Indiana, made the presentation for this bill. He stated that the substitute bill requesting <br />the zone change from single family (SF1) to “O” Office District is a better choice for the <br />proposed development along the Ireland Road Corridor. He urged the Council favorable <br />consideration of this bill. Mr. Schalliol stated that Redevelopment purchased this lot to <br />help secure the area. <br />Mr. Tyler Glynn, Edward Jones Investments, 910 Ireland Road, South Bend, Indiana, <br />stated that he is the contingent purchasers of this property. He is currently located just <br />east of this property. He would like to move his investment business to a location more <br />10 <br /> <br />
