Dale Time <br />This Substance Abuse Testing Progranthas been mlifled, signed and scaled as of <br />. by the Local Unions of Laborers' Intcntaliunal Union of <br />North America Slate of Indiana District Counci€, <br />SUBSTANCE ABUSE TESTING PROGRAM <br />AUTHORIZATION FOR CONSENT TO DRUG AND ALCOHOL <br />ANALYSIS <br />AND <br />AUTHORIZATION FOR RELEASE OF RESULTS <br />I, the undersigned <br />do hereby authorize the testing of my body fluids andlor breath for employment reasons and <br />understand and agree that the results of any such testing µill be turned over to the Employer and <br />the Union, further that the testing procedures will be limited to tests for prohibited and illegal <br />drugs and controlled substances nod alcohol. <br />I understand that The results of these tests may be used for employment and disciplinary <br />reasons and hereby authorize the release of such informalion from the laboratories to the <br />designated Employer and Union representatives. <br />I further certify that any urine specimen collected from me is mine and nal adulteraled or <br />uttered in an)' manner. <br />I have been advised that mailers affecting me relalive to the interpretation or application <br />o€the Drug Policy are subject exclusively to Ilia grievance and arbitration procedure under my <br />Collective Bargaining Agreement. <br />Signature ofProslimivo employcOEmployee <br />LETTER OF UNDERSTANDING <br />LEIFIT-R OF UNDERSTANDING FOR THE AGREEMENT by and between Ind€nna <br />Constructors, Ent. Labor Relations Division and the Local Unions off.al—crg' Intermilionid <br />Union of North America Stale of Indiana District Council concerning the Substance Abuse <br />Testing Program. <br />In regard 10 the Substance Abuse Testing Program, it is understood between the parties that <br />under this progmm, the following guidelines µill be followed when a person lesis positive: <br />First Positive Test <br />Results in immediate lamination. <br />For Reinstatement: <br />• Provide a negative "5-panel US DOT" test result as interpreted by an MRO. <br />• Sporadic testing for one(]) year following reinstalemenl- <br />Second Positive Test <br />Results in immediate tennination. <br />For Re€nslalement: <br />• Be evaluated by asr SAP. <br />• Complete an SAP -recommended rehabiiitalion progmm. <br />• Secmu writlen release (runt the SAP to retum to work. <br />• Provide a negative "5-panel US DOT" test resull as ilrtcrpmtcd by an MRO. <br />• Sporadic testing for one year following reinstatement. <br />Third and Additional Positive Test <br />Results in immediate termination; not eligible for reinstatement for six (6) months, <br />For Reinstatement: <br />• Be evaluated by an SAP. <br />• Complete an SAP -recommended rehabilitation program. <br />• Secure written release from the SAP to return to We& <br />• Provide a negative "5-pane€ US DOTT"lest result as interpreted by an MRO. <br />• Sporadic testing toy tun (2) years follwsing reinstatement. <br />FURTHER it is understood that any costs associated with lie SAP, MRO, Rehabiblaaion <br />Program, and testing required to be reinstaled, are the employees responsibility. <br />
