(a) Purpose and Authority. <br /> The NNDA is hereby created and is applicable to all real property located within the NNDA as <br /> depicted on the Zoning District Map for the City of South Bend. The NNDA is created for the <br /> following purposes: <br /> (1) To establish a comprehensive design approach for the Northeast Neighborhood <br /> Development Area; <br /> (2) To facilitate development reviews; <br /> (3) To encourage improvement and enhancement of the neighborhood's existing <br /> properties; <br /> (4) To encourage high-quality design of future buildings and site development that <br /> preserves and enhances the character of a traditional neighborhood; <br /> (5) To create a strong, unique neighborhood identity image; <br /> (b) To provide a range of design options to address future development opportunities; <br /> and <br /> (7) To instill and enforce the sense of "pride of place" among residents, businesses, <br /> and property owners. <br /> In order to assure the compatibility of new development or major additions to existing <br /> development within the NNDA with the surrounding community, any (i) new construction; (ii) <br /> building addition; (iii) new or expanded surface parking area; (iv) exterior building renovations <br /> that require a building permit; or (v) new or materially modified freestanding sign, within the <br /> NNDA after the effective date of the NNDA is subject to the approval of a Development Plan for <br /> Design Review by the Building Commissioner. However, the provision stated in the immediately <br /> foregoing sentence is not applicable to improvements on Single Family Residential real property <br /> if the construction of those improvements was substantially completed before the effective date <br /> of the NNDA. While not required by this ordinance, owners of existing Single Family <br /> Residential real property are encouraged to refer to the Northeast Neighborhood Design <br /> Guidelines for guidance in the development or alteration of improvements on their property. <br /> (b) Definitions. <br /> In addition to the definitions contained in Article 11, Section 21-11 Definitions, the following <br /> definitions apply in this NNDA. <br /> (1) Arcade—A series of arches supported by columns or piers; a building or part of a <br /> building with a series of arches. <br /> (2) Articulation - The relationship of contacting surfaces to create a series of plane <br /> changes in order to avoid a flat appearance. <br /> 2 <br />
