RESOLUTION NO. 2011-1 <br /> A RESOLUTION OF THE BOARD OF PARK COMMISSIONERS OF THE CITY OF <br /> SOUTH BEND, INDIANA TRANSFERRING OWNERSHIP OF A PART OF <br /> FREDRICKSON PARK TO THE STATE OF INDIANA <br /> WHEREAS, the Board of Park Commissioners of the Civil City of South Bend <br /> (Hereinafter referred to as Park Commissioners) is authorized under I.C. 36-10-4 to administer <br /> Park property for the City of South Bend; and <br /> WHEREAS., the Board of Park Commissioners is authorized to acquire and dispose of <br /> real and personal property under I.C. 36-10-4-9(c)(8); and <br /> WHEREAS, the Board of Park Commissioners under said authority has acquired and <br /> operates the property known as Fredrickson Park, including a portion more particularly described <br /> in the attached Exhibit "A"; and <br /> WHEREAS, the City. of South Bend has.received a Uniform Property or Easement <br /> Acquisition Offer from the Indiana Department of Transportation to acquire a portion of <br /> Fredrickson Park described in the attached Exhibit "A" in exchange for One Thousand Nine <br /> Hundred Dollars ($1,900,00);.and <br /> WHEREAS, the Board of Park Commissioners desires to accept the Uniform Property or <br /> Easement Acquisition Offer. <br /> NOW, THEREFORE BE IT ' RESOLVED BY THE BOARD OF PARK <br /> COMMISSIONERS OF THE CIVIL CITY OF SOUTH BEND, INDIANA that: <br /> L' The Board of Park Commissioners authorize the transfer of that portion of <br /> 1 <br /> Fredrickson Park described in the attached Exhibit A from the Department of Public Parks of <br /> the City of South Bend, Indiana to the State of Indiana. <br /> 2• The .Park Commissioners authorize the President of the Board or the Vice- <br /> President, or in the absence of the President or Vice-President, the Executive Secretary, to attest <br /> to the Deed and to any and all other documents relating to the transfer of real estate to the City of <br /> South Bend and to effect the closing of same on the advice of legal counsel; and <br /> 3. In accordance with the requirements imposed by I-C. 36-10-4-18, this transfer is <br /> subject to the approval of an Ordinance by the South Bend Common Council approving the sale, <br /> and this Resolution shall be in full force and effect upon the approval of said Ordinance. <br /> Dated this 10day of February, 2011 <br /> CITY.OF SOUTH BEND <br /> BOARD OF PARK COMMISSIONERS <br /> Robert Henry, President <br />
