405 Tuesday July 7th.,1914. Vontinued. LOCAL SEWER IMPROVEMENT RESOLUTION NO. 332. / Resolved by the Board of Public Works of the City of South Bend, Counter of St. Joseph, State of Indiana, That the construction of a local sewer,in- tended and adapted onlynfor local use by the property holders whose property abuts there- on and not intended or adapted for receiving sewerage from collateral drains, be and is the same is hereby ordered in and along DUBAIL AVENUE FRO'11A CARROLL STREET TO MIAMI STREET, viz: - Beginning at the intersections of the Bowman Creek Trunk sewer and the center line of Dubail Avenue; thence east along the center line of Dubail Avenue to the center of Miami Street with an 18 inch vitrified pipe sewer. Also beginning at the intersection of the Bownan Creek Trunk sewer and the center line of Dubail A Avenue; thence west along the center line of Dubail Avenue to t e center of Rush Street with an 1$ inch vitrified pipe sewer; thence still west along the center line of Dubail Avenue to the center of Carroll Street with a 15 inch vitri- fied pipe sewer. Together with the necessary manholes, inlets, conduits and house con- nections to the curb line along the line of said improvement. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bedd,Indiana. and said sewer, with all its appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said City. The cost of said improvement shall' be appropioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according o the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled "An Act 00 Concerning Municipal Corporations,"approved March 611905• Assessme is ,if deferred; are to be paid in ten annual equal installments, with interest at the rate of Six per cent per annum. A bndd or bonds shall be issued to the contractor lry payment for such work, unless the pro- perty owners pay said assessments before said bond or bonds are issued. Under no cir- cumstances shall the'City of South Bend be or be held responsible for any sum or bums due from said property owner or owners for said work, or for the collection of same, or for the payment of any bond or bonds, certificate or certificates, issued to said con- tractor in payment for such wdrk , ex ept for such moneys as shill have been actaully received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All preeedings had, and work done in the making of said improvement, assessment of property, Collections of assess- ments and issuance of bonds therefor, shall be as provided for in said above entitled Act* ,Notice of this resolution shall be published on the 9th., day of July,1914 and on the 16th., day of'July,1914 in the South Bend Daily News -Times. This Board will give a hearing on this resolution at its office in the City Hall on the 4th* day of Au gust,1914 at 7:45 P.M. Adopted this 7th., day of July21914. The Board instructed the Clerk to Co. The Home Telephone Co., the Central Union Tel. Western Union Telegraph Company and A.T.&T.
