ENGINEERS -JOINT CON]"RAUf DOCUMENTS COMM11"TEE AGREEMENT BETWEEN OWNER AND ENGINEER FOR PROFESSIONAL SERVICES THIS IS AN AGREEMENT effective as of JUP tA)� , D f 6 ("Effective Date") between Board of Public Works, City of South Bend, Indiana ("Owner") and Black & Veatch Corporation ("Engineer"). Owner's Project, of which Engineer's services under this Agreement are a part, is generally identified as follows: Wastewater Treatment Plant Electrical Improvements Design and Construction Phase Services ("Project"). Engineer's services under this Agreement are generally identified as follows: The purpose of this, project is to develop contract documents for needed electrical improvements at the Wastewater Treatment Plant to maintain a high level of service during wet weather events where treatment capacity of 48 mgd (normal) to 77 mgd (peak) conditions are critical to treatment operations. Improvements were identified as options N2 and components of N4 from the WWTP Electrical Evaluation Report. In addition, a study to evaluate the potential capture of solar energy at the WWTP site will be oerformed. Owner and Engineer further agree as follows: ARTICLE 1 — SERVICES OF ENGINEER 1.01 SCOI)e A.
