®CITY OF SOUTH BEND I OFFICE OF THE CLERK
Ms. Mauller replied, Typically it comes in but I would be happy to take that compliant right now.
Mr. Molchan stated, I would also like to add that, according to the change in the State Code this
yar, the person affected by the complaint is the person having to file the complaint because that
is the person that can give us the right to do the inspection.
Committeemember White asked, How many Inspectors do you have? And are there certain areas
they are responsible for?
Ms. Mauller replied, We have, within the Environmental Division, twelve (12) individuals
counting myself. There are two (2) staff individuals as well in the form of Staff Assistant,
Administrative Assistant and an Assistant Director. That is eight (8) Environmental Health
Specialists for twelve (12) program areas. For the most part, there is one (1) individual that is
assigned to handle complaints. Although, we are breaking that up into someone else. That is
something we are looking at.
Committeemember White followed up,Do you have statistics to show from, say,2017,how many
complaints and investigations there have been?
Ms.Mauller replied,We have a number of complaints and we do keep the nature of the complaints.
Within those numbers are septic, water and all of that.
Committeemember White stated, I think that would be good information. We are very concerned
about what is happening at the Colfax Apartments. If we could have that information, that would
be very helpful.
Councilmember Dr. Varner stated, I didn't know about the law changing but when you have the
issue of this nature, and you receive the complaint and you go out,who do you serve the order to?
Does it go to the owner, the landlord or tenants? What this devolves into is the landlord passing
on this payment to the tenants and,if neither are held responsible, you have an unsolvable problem.
Ms. Mauller replied, It depends on what it is. I will go to either the owner or the landlord. Certain
items may go to the tenant if it is a condition within a lease or contract. I have actually seen leases
that say the tenant is responsible for pest control and other things. It depends on what the lease
says the tenant is responsible for.
With no further business, Vice Committee Chair Voorde adjourned the Health and Public Safety
Committee meeting at 4:01 p.m.
Respect Submitted,
Jo orde,Vice Committee Chair
EXCELLENCE I ACCOUNTABILITY I INNOVATION I INCLUSION I EMPOWERMENT
455County-City Building 227W.Jefferson BvldI South Bend,Indiana 46601 p574.235.9221lf574.235.9173ITM574.235.5567Iwww.southbendin.gov
6
