ORDINANCE NO. 1 - �1 AN ORDiNANCR TO VACATE THE VOL'LOWING DNSCRIBUD PROPERTY A STRIP OF TI3E NAPOLEON STREET RIGHT-OF-WAY FIFTEEN FEET (15 9 WIDE ADJACENT AND PAMLUL, TO THE NORTH LINE OF LOT A OF E & M GOERNER REPLAT FROM THE WEST LINE OF SAID LOT A THENCE EASTWARD ALONG LOT A AND -LOT 47 OIL SORIN'S 2"' ADDITION TO THE EAST LINE OF LOT 47, A DISTANCE OF 265.90 FEET MORE OR LESSp AND, A STRIP OF THE 14APOLEON STREET RIGHT-OF-WAY FIFTEEN FEET (159 WIDE ADJACENT AND PARALLEL TO THE NORTH LINT: OF LOT 41 OF SORIN'S 2N° ADDITION WEST LING OF SAID LOT 41 THENCE EASTWARD TO THE EAST LINE Or LOT 35, A DISTANCE OF 344 FEET MORE OR LESS; ALL IN THE CITY OF SOUTH SEND, SAINT JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH SEND, INDIANA, as follows! agg=bj . The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property; A strip of the Napoleon Street right-of-way fifteen feet (1511) wide adjacent and parallel to the north line of Lot A of 8 & M Goerner Replat from the west line of said Lot A thence eastward along Lot A and Lot 47 of Sorin's 2" Addition to the east lire of Lot 47, a distance of 265.98 feet more or less; and, a strip of the Napoleon Street right-cf-way fifteen feet (151) wide adjacent and parallel to the north line of Lot 41 of Sorin'e 21d Addition west line of said Lot 41 thence eastward to the cant line of Lot 35, a distance of 344 feet more or less, all in the City of South Band, Saint Joseph County, Indiana Hereby determines that it is desirable to vacate said property.
