Zoning and Annexation Committee <br />,iuly 9, 2007 <br />Page 2 <br />In response to a question from Council Member Kirsits, Mr. Kevin Vernick of 2000 North <br />Racine, Suite 2110, Chicago, Illinois 60614 notes that Sherman Williams plans to <br />located at this site. It would be one of two locations in South Bend. <br />Chris Gressel, of the Department of Community of Economic Development spoke in <br />favor of the substitute bill on behalf of the department and the City Administration. <br />No ane spoke in opposition. <br />Council Member Kuspa noted that he believes that the proposed Sherman Williams <br />store will be an asset to the community. He then made a motion, seconded by Council <br />Member Pfeifer that Substitute Bill No. 29-07 be recommended favorably to Council. <br />The motion passed. <br />Council Member Pfeifer noted that she concurs with Council Member Kuspa and <br />thanked the Sherman Williams representative for choosing South Bend. <br />Substitute Bill No, 2fi-07 Rezonin Re oast for 24.345 Acres Between An efa <br />Boule~ardlEdison Road and Na oleon <br />Council Member Kirsits noted that the Petitioners would have approximately twenty (20) <br />minutes for their formal presentation before the Committee, followed by thirty (30) <br />minutes for those persons wishing to speak in favor and thirty (30) minutes for those <br />persons wishing to speak in apposition. He stated that there would also be <br />opportunities to speak at this evening's Common Council meeting scheduled to begin at <br />7 p.m.; as well as at the Special Common Council meeting called for next Monday, July <br />16, 2007 at 7 p.m. <br />Council Member Kirsits then called for a report from the Area Plan Commission staff on <br />Substitute Bill No. 26-07 would requests to rezone 24.345 acres generally located <br />between Angela BoulevardlEdison Road and Napoleon Street, and approximately 200 <br />fee west of Eddy Street and 700 feet east of Duey Street, extended, located in the 4~" <br />Councilmanic District. <br />Robert Nemeth of the Area Plan Staff reported that the Area Plan Commission held a <br />public hearing on the Substitute Bill on June 19, 2007. The petitioner requests the <br />property be rezoned from U University District and S1=2 Single Family and Two Family <br />District to PUD Planned Unit Development District. He noted that the Area Plan <br />Commission sends the request with a favorable recommendation. He noted that the <br />Commission found that "the rezoning is consistent with the City Plan land use policy, <br />which encourages planned unit development and the Future Land Use map, which <br />recommends mixed land use. It promotes the infill development and growth adjacent to <br />two main transportation corridors and near another major thoroughfare where city <br />utilities and services are available.
