REGULAR MEETINGOCTOBER 8, 2007 <br /> <br /> <br /> <br /> <br />Councilmember Kirsits, Chairperson, Zoning & Annexation Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and sends it to the full <br />Council with a favorable recommendation. <br /> <br />th <br />Ms. Christa Nayder, Staff Planner, Area Plan Commission, 11 Floor County-City <br />Building, 227 W. Jefferson Blvd., South Bend, Indiana, made the presentation for this <br />bill. <br /> <br />Ms. Nayder stated that this bill is initiated by the Area Plan Commission and amends <br />Chapter 21 of the South Bend Municipal Code, Article 14, Subdivisions, Section 21- <br />14.05 Major Subdivisions to revise the approval process for major secondary <br />subdivisions plats. This bill is sent to the Common Council with a favorable <br />recommendation. Ms. Nayder advised that this change to the subdivision ordinance will <br />reduce the amount of time that it now takes to receive secondary approval of major <br />subdivisions. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br /> <br />Councilmember Puzzello made a motion for favorable recommendation to full Council <br />concerning this bill as substituted. Councilmember Dieter seconded the motion which <br />carried by a voice vote of eight (8) ayes. <br /> <br /> <br />BILL NO. 61-07 PUBLIC HEARING ON A BILL AMENDING <br /> THE ZONING ORDINANCE AND <br /> ESTABLISHING AN HISTORIC LANDMARK <br /> FOR THE PROPERTY LOCATED AT 1905 <br /> COLLEGE, IN THE CITY OF SOUTH BEND, <br /> INDIANA <br /> <br />Councilmember Dieter made a motion to hear the substitute version of this bill. <br />Councilmember Varner seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br /> <br />Kathleen Cekanski-Farrand read the procedures for tonight’s Council Meeting into the <br />record. She noted that Chairperson White will ask for report from the Zoning and <br />Annexation Committee, Councilmember Kirsits, Chairperson, will give the advisory <br />recommendation to the full Council. A formal presentation will take place by the <br />presenter. The formal presenter will at that time identify all individuals that will be <br />speaking so that the Council will know when the close of that presentation takes place. <br />The remonstrators will also be asked to identify who will be speaking. Neither the <br />presenter nor the remonstrator will be subject to a time limitation. Members of the public <br />will have the opportunity to address the Council. They will need to give their name and <br />address and they will be limited to five (5) minutes each, to speak either in favor first, <br />followed by those wishing to speak in opposition. Council Rules provide that the public <br />portion of the committee that is not the formal presentation but just the public portion is <br />limited to the time again, the remonstrators are limited in time to that which was spent for <br />those that spoke in favor or 30 minutes which ever is greater. Following that the <br />presenter will have an opportunity to give a total of five minutes in rebuttal to address <br />any questions that might have been raised by members of the public or as part of that <br />presentation. This evening the Council is here to entertain a proposed Historic Landmark <br />Designation. A local landmarks is defined as follows: A building, site, landscape, <br />structure, object or area that demonstrates the historic an or architectural significance of a <br />period in time of South Bend, St. Joseph County, the region, the State or the Nation. <br />The Council this evening is limited in their review when reviewing a local landmark <br />designation to the following criteria: They are restricted to look at whether the proposal <br />is of historic or architectural significance or both. As a part of that review they may look <br />at whether the elements of architectural design, detail, material or craftsmanship <br />represent architectural characteristic or innovation. They may look at the suitability for <br />preservation and the identification of life of persons or individuals of historic significance <br /> 6 <br /> <br />
