REGULAR MEETINGOCTOBER 8, 2007 <br /> <br /> <br /> <br /> <br />UNFINISHED BUSINESS <br /> <br />REPORT FROM BOARD OF ZONING APPEALS <br /> <br />BILL NO. 07-126 A RESOLUTION OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> APPROVING A PETITION OF THE SOUTH <br /> BEND BOARD OF ZONING APPEALS FOR <br /> THE PROPERTY LOCATED AT BETWEEN 228 <br /> NOTRE DAME AVENUE AND THE FIRST <br /> EAST-WEST ALLEY NORTH OF WAYNE <br /> STREET <br /> <br />Councilmember Varner made a motion to refer this bill to the Zoning & Annexation <br />Committee and set if for Public Hearing and Third Reading on October 22, 2007. <br />Councilmember Dieter seconded the motion which carried by a voice vote of eight (8) <br />ayes. <br /> <br />MOTION TO CONTINUE BILL NO. 47-07 <br />Councilmember White made a motion to continue Bill No. 47-07 indefinitely. <br />Councilmember Dieter seconded the motion which carried by a voice vote of eight (8) <br />ayes. Additionally, Councilmember White stated that there will be a Health and Public <br />Safety Committee Meeting on October 24, 2007 at 3:00 p.m. to continue discussion of <br />Bill 47-07. <br /> <br />NEW BUSINESS <br />Councilmember Pfeifer stated that in light of the late hour, she will give an update on the <br />Vacant Properties Conference at the next meeting of the Council. <br /> <br />Councilmember Varner stated that as of September 28, 2007, Comcast will no longer be <br />broadcasting the South Bend Common Council Meetings. He noted that there has been a <br />change in the way the law reads relieving Comcast from their duty of video taping any <br />public meetings. Councilmember Varner noted that he has been in contact with Angel <br />Hernandez, WNIT “Public Access Channel” to discuss the possibilities of having the <br />Council Meetings broadcast over the public access channel. <br /> <br />PRIVILEGE OF THE FLOOR <br /> <br />COMMENTS FROM MR. SINCLAIR POINDEXTER REGARDING COMCAST <br />Mr. Sinclair Poindexter, 1046 Georgiana, South Bend, Indiana, stated that he is a <br />professional videographer, producer and director. He studied at Ivy Tech and did his <br />internship under Greg Giczi, WNDU, Channel 16,, He stated that Mr. Giczi is now the <br />station manager at Arizona State University, Tempe. He stated that he has been a <br />broadcaster on public access for fourteen (14) years and he also stated that he is a citizen, <br />a taxpayer and a registered voter. Mr. Poindexter noted that most of the Council has been <br />on his television program. He noted that he has given personal interviews and has had <br />discussions of some of the activities that the Council has been involved with around <br />town. He stated that he is very disheartened when he tried to call his elected officials <br />about this Comcast situation. He stated that he was told that they were too busy with the <br />campaign to even deal with it. He stated that he had to file an Access to Public Records <br />form to get any information related to Comcast when this information has been sitting on <br />the City Attorney’s desk for weeks. He stated that this Comcast is very important and he <br />understands that WNIT is taking over it. Mr. Poindexter noted that he has been exposed <br />to WNIT, twelve to thirteen years ago and because of racists attitudes he was not allowed <br />to broadcast. He thinks that as a broadcaster, producer and a member of this community, <br />he ought to be in on the ground floor in the planning stages of when this thing is getting <br />ready to be turned over to WNIT and thinks that this is more than fair. He stated that Ms. <br />Carol Davis, is a broadcaster to and that they have been working together to try to meet <br />with their elected City Officials to try to resolve this problem. He stated that they have <br />asked if they could be of some kind of assistance and yet steady the doors are being <br />closed in their face and for what, they don’t know.
