Zoning and Annexation Committee Meeting <br />2010 South Bend Common Council <br />The July 12, 2010 meeting of .the Zoning and Annexation Committee of the South Bend Common <br />Council was called to order by its Chairperson Council Member AI "Buddy" Kirsits at 4:00 p.m. in <br />the Council's Informal Meeting Room, 4t Floor of the County-City Building. <br />Persons in attendance included Council Members: Dieter, Puzzello, Varner, Rouse, Kirsits, and <br />and White; Rita Kopola, Derek Spier, Catherine Pittman, Mark Lyons, Public Works Director Gary <br />Gilot, P.E., David L. Mirkin, Todd Stull, and Kathleen Cekanski-Farrand, Council Attorney, .and <br />members of the television media. <br />Council Member Kirsits noted that the committee members include Council Members Oliver Davis <br />who is the Vice-Chairperson, Dr. Varner, Thomas LaFountain and himself. Council Member Kirsits <br />stated that Council Member Oliver Davis is attending the funeral of his Mother and extended his <br />deepest sympathy to him and his family. He also noted that Council Member LaFountain is on <br />vacation with his family. As a result there is not a quorum present and all Bills will be heard and <br />will be sent to the Common Council without recommendation. <br />Substitute Bill No. 24-10 Rezoning Request for 850 Fellows Street <br />Council Member Kirsits called for a report from Area Plan on Substitute Bill No. 24-10. <br />Derek Spier, a Planner with Area Plan gave the report. He noted that the request is from H.G. <br />Christman Construction Company, Inc. and is requested a zone change from LI Light Industrial <br />District to GI General Industrial District to allow a wrecker service on 2.3 acres. At the June 15, <br />2010 the Area Plan Commission held a public hearing where there were no remonstrators. The <br />Area Plan Commission sends the request to the Council with a favorable recommendation. <br />Mr. David L. Mirkin, an attorney with offices at112 West Jefferson Boulevard, Suite 400 in <br />downtown South Bend made the formal presentation. Mr. Mirkin that he represents LTODD, LLC <br />whose principal owner is Todd Stull who is present with him today.) They operate a company <br />called Bestway Towing who does the majority of their business towing for the City of South Bend. <br />Approximately 60% to 70% of their business is for the city where they need a vehicle impounded or <br />towed. They will move from their current location on Walnut Street. <br />In response to a question from Dr. Varner, Mr. Mirkin stated that they do not do any long time <br />storage. <br />In response to a question from Council Member White, Mr. Mlrkin stated that they average 35-45 <br />vehicles being towed per week. <br />Council Member Kirsits noted that he play Park League ball with Todd Stull and has known him for <br />many years. He will be supporting this request this evening. <br />There was no one from the public to speak in favor or in opposition. In light of a quorum not being <br />present, no formal action was taken on the Bill by the Committee. <br />
