South Bend Redevelopment Commission
Rescheduled Regular Meeting -July-9, 2010
5. OLD BUSINESS (CONT.)
B. Airport Economic Development Area
(1) continued...
complete their cleanup.
Mr. Meteiver noted that the Comfort Letters
are "prospective purchaser" letters. They
don't limit the city's liability for anything it
has done to the property, but they do absolve
the city of any liability for prior acts that led
to the current condition of the property. The
city also has protection under the Indiana
state statute, which adopts the Circla federal
environmental statute which provides
protection for a governmental entity that
accepts transfer from another governmental
entity. The county is protected by a different
section of that law when they involuntarily
become owners through tax sale.
Upon a motion by Mr. Alford, seconded by
Ms. King and unanimously carried, the
Commission approved Resolution No. 2689
accepting the transfer of real property from
St. Joseph County, Indiana.
