Tu es day , June I �t h . , 1930. <br />whatsoever for damages of any nature whatsoever due to the failure in the supply of <br />electric energy or any interrupti on of or deficiency in the same, and the City hereby x :._ :z; o <br />agrees to indemnify and save harmless the Contractor from. any Toss, cost or damage <br />which may be occassioned by any -of, the causes herein in this paragraph set forth. <br />3. The number of lamps furnished and 1 ight ed by Contractor un <br />der this contract shall be .the number provided for in Paragraph "I" hereof abd shall <br />be located as shown on prints attached hereto and indentified by the signatures, of <br />the Contractor and the Board of Public Works. <br />4. All. outages of lamps provided for in Paragraph "Itt shall <br />be reported daily in writing by the proper officials of the City to the Contractor and <br />the proper officials of the City may deduct from the'total monthly amount which <br />would have been paid fvz any lamp so reported on any outage, occurring, the sum bear- <br />ing the ratio to such total as the period of outage bears to the total time the lamp <br />would have been lighted in any month. <br />5. Street lighting united in Paragraph "I" contrasted for <br />shall be moved by the Coiitractcr to such new location as the City may by.writing <br />direct, sgb j ect to the following conditions: <br />Such moving of lamps shall be completed within thirty (30 ) <br />days after receipt by contractor of written notice from the city, Sundays, legal hol- <br />idays and stormy days not to be included, provided that the number of such removals <br />shall not exfeee one per day and provided further that such renewals shall not be re- <br />quired on Sundays, le ga 1 holidays and stormy days. Notice that the work of such re <br />moval of lamps has been completed shall be given by the Contractor to the City within <br />ten (TO) days after completion of the work. <br />The actual cost to the Contractor for making such reloeetions <br />shall be pfid by the City to the Contractor within thirty days after said notice has <br />been given. <br />6. Additional traffic directors or special indicators of like <br />type and characteristics as those provided for in Paragraph "2" hereof may be added <br />from time to time by the City and the Contractor shall upon written notice from the <br />City furnish electricity for lighting same and payment therefor shall be at the rate <br />provided for in this contract, commencing on the day on thich the units are to be in <br />service. <br />7. The City shall accept such lamps and the services herein <br />specified dur ing the life of th is <br />contra ct <br />and <br />pay as full compensation therefor at <br />the ra to and pr ice set out i n the <br />a ccepted <br />bid <br />to -wit <br />I.
