ROOM 1140 COUNTY -CITY BUILI)I\t;, SOUTH BEN1), INDIANA 46601 (i74) 13i-9571 <br />July 21, 2017 <br />City of South Bend <br />Board of Public Works <br />131h Floor, County -City Building <br />South Bend, Indiana 46601 <br />RE: Street Vacation <br />Applicant: Contreras <br />Location: Ist N/S alley W of William, Between Madison and 1" E/W alley N of Madison <br />Dear Board Members: <br />The staff has reviewed this petition relative to IC 36-7-3-13. 1t is the staff's opinion that: <br />(1) The vacation would not hinder the growth or orderly development of the unit or neighborhood in which it is <br />located or to which it is contiguous. <br />The block serviced by this alley is fully developed. All properties within the block have direct access to <br />neighboring public streets, Further development or redevelopment of the block would benefit from direct access <br />to the adjacent public ways. <br />(2) The vacation would not make access to the lands of the aggrieved person by means of public way difficult or <br />inconvenient, <br />Access to all affected properties is provided by adjacent public streets. There are two large, church -affiliated <br />parking lots to the north of the proposed alley vacation. The alley system within the block provides enhanced <br />access to these parking lots, helping to efficiently distribute traffic to the major streets, Vacation of this portion <br />of the system would not significantly compromise access, although the creation of a "right-angle" turn would <br />make continued use of the remaining alley difficult, if not impossible for some vehicles. <br />(3) The vacation would not hinder the public's access to a church, school, or other public building or place, <br />The alley does provide secondary access to a church, Temple Beth El, As noted in Criteria #2, above, that <br />portion of the alley proposed to be vacated appears to function as secondary access for the Temple parking fats. <br />The Temple has direct access from their parking lots to the adjacent streets. <br />(4) The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it <br />is contiguous. <br />The vacation may hinder access to other adjacent public ways.
