<br /> This being the time heretofore set for the Public Hearing on the above bill,proponents and
<br /> opponents were given an opportunity to be heard.
<br /> Those from the public wishing to speak in favor of this bill:
<br /> Jesse Davis, P.O. Box 10205, South Bend, IN, stated that the nuisance ordinance does not seem
<br /> to have teeth and that it is being selectively enforced. Mr. Davis stated, I truly believe that we
<br /> need to look at this and let this man run his business. Why try to hamper another business in
<br /> town?
<br /> Lawrence Chudzinski, 10026 Shadow Wood Drive, Granger,IN, stated that Mr. Burg was
<br /> always concerned with being righteous in his business with Mr. Chudzinski. He stated, All Bob
<br /> is doing is the American dream of wanting to be an entrepreneur.
<br /> Speedy Singleton, 1332 Ford Street, South Bend,IN, stated that this bar has helped bring
<br /> members of the community grow closer to each other.
<br /> May Markowitz, 51250 Tamarack Road,New Carlisle, IN, stated that she has been the manager
<br /> of the Friendly Confines since its founding. Ms. Markowitz stated that one (1)person has been
<br /> consistently complaining about the bar, effectively bullying them for the past two (2) years. She
<br /> stated that the complaints were not just for noise,but for things like gun shells found on her lawn
<br /> that the neighbor falsely attributed to the bar, or cars parked on the curb by the bar (where it is
<br /> not clear whether or not the parked car belongs to a bar patron).
<br /> Katie Reeves, 1001 South Mayflower Road, South Bend, IN, stated that the Friendly Confines is
<br /> one (1) of the safest bars in town and that they have invested in the community.
<br /> Tessa Harris, 54450 North 30th Street, South Bend, IN, stated that in an otherwise unsafe
<br /> neighborhood, she has always felt safe and welcome at the Friendly Confines. Ms. Harris stated
<br /> Bob Burg is a wonderful man and that he will continue to do things that will improve the
<br /> community.
<br /> Lisa Popielski, 55345 Lexington Avenue, South Bend, IN, asked why a nearby bar could have an
<br /> outdoor area but the Friendly Confines couldn't.
<br /> Mark Florkowski, 605 Kosciuszko Street, South Bend, IN, stated that the bar is a great, clean
<br /> place with friendly people.
<br /> Victoria Kucharski, 805 South Walnut Street, South Bend, IN, stated that, in the past,the
<br /> property in question was often vandalized and left in disarray. Mr. Burg has kept the property
<br /> clean and presentable and crime-free. Ms. Kucharski stated that she gets up for work at 3 a.m.
<br /> and that she is never kept up or disturbed by boisterous behavior. She asked, Our question is,
<br /> why is this all happening now when it's been a bar for as long as anybody in that neighborhood
<br /> can remember? Like the other people said, we've not had any music in over a year, so I don't
<br /> know what the problem is at this point.
<br /> Sadie Brown, 230 Sadie Street, South Bend, IN, stated that she agrees that this is a case of
<br /> selective enforcement as she has been trying to get the City to address a drug dealer living near
<br /> her, while a man trying to run a business in compliance with City statute is getting unwanted and
<br /> undeserved attention. Ms. Brown stated, Leave this gentleman alone.
<br /> Samuel Brown, 222 Navarre Street, South Bend, IN,urged the Council to allow Mr. Burg to
<br /> conduct his business in peace.
<br /> Sharon Banicki, 3822 Ford Street, South Bend, IN, stated that Mr. Burg is bending over
<br /> backwards to please everybody, but his efforts keep getting impeded by roadblocks. Ms. Banicki
<br /> stated, It's been a bar since my uncle owned it. Let it continue to be a bar.
<br /> Those from the public wishing to speak in opposition to this bill:
<br /> Kevin Wooding, 821 South Walnut Street, South Bend, IN, stated that Mr. Burg has established
<br /> himself as an irresponsible,untrustworthy, and inconsiderate business owner, noting that the
<br /> establishment is on a one (1) year probationary period with the Alcohol Board due to
<br /> 21
