DUNHAM, <br /> SOUTH BEND, INDIANA 46619 <br /> Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee,reported that <br /> they met this afternoon and send this bill forward with no recommendation. <br /> Bob Palmer, Council Attorney, stated, The Common Council is acting as a quasi-judicial board <br /> instead of a legislative board,therefore it is limited to specific criteria in determining whether the <br /> application or the petition should be granted. The four(4) specific criteria are: one (1), whether <br /> the proposed use will be injurious to public safety, comfort, community moral standards, <br /> convenience, or general welfare; two (2), whether the proposed use will injure or adversely affect <br /> the adjacent area or property values therein;three (3),whether the proposed use will be <br /> consistent with the character of the district within which it is located and the land uses authorized <br /> therein; four(4), whether the proposed use is compatible with the recommendations of the City <br /> of South Bend Comprehensive Plan. The Council will only consider the record of proceedings <br /> before the Area Board of Zoning Appeals and any documents presented therein, or the record of <br /> proceedings in this Public Hearing and any documents presented; any and all documents <br /> 9 <br />
