divulge information, processes, or methods of production entitled to <br />protection as trade secrets under the Indiana Access to Public Records Act <br />(IC 5-14-3-4 (A) (4)). <br />Any such request must be asserted at the time of submission of the <br />information or data by stamping the words "confidential business <br />information" on each page containing such information. When requested <br />and demonstrated by the permittee furnishing a report that such information <br />should be held confidential, the portions of a report which might disclose <br />trade secrets or secret processes shall not be made available for inspection <br />by the public, but shall be made available immediately upon request to <br />governmental agencies for uses related to the NPDES program or <br />pretreatment program, and in enforcement proceedings involving the person <br />furnishing the report. <br />b. Wastewater constituents and characteristics and other effluent data, as <br />defined at 40 CFR 2.302 shall not be recognized as confidential information <br />and shall be available to the public without restriction. <br />c. All other information which is submitted to the State or Board of Public <br />Works shall be available to the public at least to the extent provided by 40 <br />CFR 2.302. <br />11. Transfer of Ownership or Control <br />a. This permit may be transferred to a new owner or operator only if the <br />permittee gives at least thirty (30) days advance notice to the Director and <br />the Director approves the individual wastewater discharge permit transfer. <br />The notice to the Director must include a written certification by the new <br />owner or operator which: <br />i. Identifies the new owner or operator, including address and telephone <br />number; <br />ii. Identifies the Authorized Representative for the new owner or <br />operator in accordance with Part IV (B) (1 S) of this permit, including <br />telephone number and email address; <br />iii. States that the new owner and/or operator has no immediate intent to <br />change the facility's operations and processes; <br />iv. Identifies the specific date on which the transfer is to occur; and <br />v. Acknowledges full responsibility for complying with the existing <br />individual wastewater discharge permit. <br />b. Failure to provide advance notice of a transfer renders this permit void as <br />of the date of transfer. <br />12. Reopenin Clause <br />21 <br />
