TEMPORARY EASEMENT GRANT <br />(FOR CONSTRUCTION OF TREE REMOVAL AND/OR RESTORATION) <br />Project: Corby Street Sidewalk <br />Improvements <br />Project No. 116-087 <br />If I' THIS INDF,pITURE ITN_ ES$ETH, That <br />" 4M l f4 1--.�((i�J (XYIQ Of Indiana, Grant (a) to the CITY OF SOUTH BEND, the <br />Grantee, Yor add in consideration of the sum of ONE ($1.00 Dollar) and other good and valuable <br />consideration, the receipt of which is hereby acknowledged, a temporary easement to enter upon and <br />have possession of the Real Estate of the Grantor(s) land for the purpose of tree removal and <br />restoration on the Grantor's property, which said Real Estate situated in the City of South Bend, <br />County of St. Joseph, State of Indiana, and which is more particularly detailed per Exhibit "A" legal <br />description and on an easement parcel plat attached hereto as Exhibit "B", which is incorporated <br />herein by reference except the extinguishment of said temporary easement shall be released following <br />construction of the sidewalk Improvements along Corby Street. <br />Any and all timber, shrubbery, fences buildings, and any other improvements situated within <br />the area of the temporary easement granted herein shall become the property of the City of South <br />Bend, except: None. <br />The Grantor (a) acknowledges that all provisions of this grant of temporary easement are as <br />stated and set forth herein and that no verbal agreement or promises exist with respect thereto. <br />This temporary conveyance is subject to any and all easements, conditions, and restriction of <br />record.
