<br />That part of the Northeast Quarter of Section 13, T. 37 N., R. 2 E., Portage
<br />Township, City of South Bend, St. Joseph County, Indiana which s know as the
<br />West 128.00 ft. of Lot 119 as shown on the recorded Plat of "Wenger's Fifth
<br />Addition," as recorded in the Office of the Recorder of St. Joseph County,
<br />Indiana and being more particularly described as: Beginning at the Northwest
<br />corner of Lot 119; thence S. 89 degrees, 41 minutes, 35 seconds E., 128.01 ft.
<br />(128 ft., Record); thence S. 01 degrees, 02 minutes, 30 seconds W., 60.00 ft.;
<br />thence N. 89 degrees, 41 minutes, 35 seconds W., 128.03 ft. (128 ft., Record);

<br />A tract of land Seventy (70) feet in length, East and West, taken off of and from
<br />the entire width of the East end of Lot Numbered One Hundred Nineteen (119)
<br />as shown on the recorded Plat of Wenger's Fifth
<br />Addition, recorded June 17, 1892 in the Office of the Recorder of St. Joseph
<br />County, Indiana, in Plat Book 6, page 21. Commonly known as 1216 1/2
<br />Fellows. Key No. 18-7023-090901
<br />Parcel IX:
<br />Lot Numbered One Hundred Two (102) as shown on the recorded Plat of
<br />Wenger's Fifth Addition to the City of South Bend, Indiana, recorded June 17,
<br />1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book
<br />6, page 21. Key No. 18-7023-0894.
<br />(hereinafter collectively referred to as the Real Property) and;
<br />WHEREAS, the Commission, in Resolution 1336, adopted on April 7, 1995, expressed its
<br />desire to transfer the Real Property to the City of South Bend, Indiana; and
<br />WHEREAS, the City of South Bend is desirous of acquiring the Real Property from the
<br />Commission, but only upon the condition that the Commission assume financial responsibility for
<br />removing the structures situated upon Parcels I, II, IV, V, VI and VIII of the Real Property; and
<br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend
<br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and through the
<br />Board, may exchange or transfer property with another governmental entity upon terms and
<br />conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical
<br />resolutions of each entity; and
<br />WHEREAS, the Commission has agreed to transfer the Real Property to the City of South
<br />Bend, and has agreed to assume financial responsibility for the removal of the structures situated
<br />upon Parcels I, II, IV, V, VI, and VIII of the Real Property, and the City of South Bend, acting by
<br />and through the Board, has agreed to accept the transfer of the Real Property from the Commission
<br />for the payment of a nominal consideration.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
<br />THE CITY OF SOUTH BEND AS FOLLOWS:
