Key No. 18-7023-090901 <br />Parcel IX: <br />Lot Numbered One Hundred Two (102) as shown on the recorded Plat of <br />Wenger's Fifth Addition to the City of South Bend, Indiana, recorded June 17, <br />1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book <br />6, page 21. Key No. 18-7023-0894. <br />(hereinafter collectively referred to as the Real Property) and; <br />WHEREAS, the Commission, in Resolution 1336, adopted on April 7, 1995, expressed its <br />desire to transfer the Real Property to the City of South Bend, Indiana; and <br />WHEREAS, the City of South Bend is desirous of acquiring the Real Property from the <br />Commission, but only upon the condition that the Commission assume financial responsibility for <br />removing the structures situated upon Parcels I, II, IV, V, VI and VIII of the Real Property; and <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend <br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, the City of South Bend, acting by and through the <br />Board, may exchange or transfer property with another governmental entity upon terms and <br />conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical <br />resolutions of each entity; and <br />WHEREAS, the Commission has agreed to transfer the Real Property to the City of South <br />Bend, and has agreed to assume financial responsibility for the removal of the structures situated <br />upon Parcels I, II, IV, V, VI, and VIII of the Real Property, and the City of South Bend, acting by <br />and through the Board, has agreed to accept the transfer of the Real Property from the Commission <br />for the payment of a nominal consideration. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND AS FOLLOWS: <br />I- <br />I- <br />
