REGULAR MEETING NOVEMBER 13, 2000 <br />RESOLUTION NO. 114-2000 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY <br />WHEREAS, it has been determined by the Board of Public Works that the following property is <br />unfit for the purpose for which it was intended and is no longer needed by the City of South Bend: <br />1971 Wand LaFrance Pumper <br />1973 Mack CJ Pumper <br />WHEREAS, Indiana Code 36-1-11-60 permits and establishes procedure for disposal of <br />personal property which is unfit for the purpose for which it was intended and which is no longer <br />needed by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board ofPublic Works ofthe City of South <br />Bend that the items listed above are no longer needed by the City; are unfit for the purpose for which <br />they were intended and have an estimated value of more than five thousand dollars ($5,000.00). <br />BE IT FURTHER RESOLVED, that said items may be transferred or sold at public auction, <br />conducted by an auctioneer licensed under I.C. 25-6.1, after advertising the property for sale. <br />However, if the property is deemed worthless, such may be demolished or junked. <br />ADOPTED this 13th day of November, 2000. <br />BOARD OF PUBLIC WORKS <br />CITY OF SOUTH BEND, INDIANA <br />s/Gary A. Jacob, Clerk <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE PROPERTY <br />Mr. Gilot indicated that the Common Council has submitted to the Board a Vacation Petition as <br />completed by Mr. Joseph Pietrzak, 24891 Kern Road, South Bend, Indiana to vacate the following <br />alley: <br />The 10 foot wide alley lying north of and adjacent to Lot 1, the 10 feet wide alley lying south <br />of, and adjacent to Lot 47 and the 12 foot wide alley lying east of, and adjacent to Lots 1 <br />through 5 inclusive all within and a part of Hartman and Miller's Plat in the City of South <br />Bend, Indiana. <br />Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation <br />Petition from the Police Department and the Fire Department. Solid Waste stated that this alley is <br />used for trash pick up. The Area Plan staff stated that if the north/south alley is vacated, garbage <br />truck traffic from the north may have difficulty maneuvering to make a turn at the intersection with <br />the first east/west alley south of St. Vincent Street. Engineering recommended some means of <br />allowing service trucks to turn at Lots 6 and 45. Community and Economic Development has an <br />unfavorable recommendation. Mr. Medow is the sole petitioner for this request to vacate three alleys <br />that are not all adjacent to his property (Lot 1). Area Plan recommends that if these right of ways <br />are vacated, they be subject to any utility easements. Therefore, Mr. Gilot made a motion that the <br />Board send an unfavorable recommendation to the Common Council concerning this Vacation <br />Petition. Mr. Inks seconded the motion which carried. <br />
