The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to Lots 38, 39, and 40, east side of Main Street, south of Pulling Street, South Bend, Indiana, (Key # 01-1041-1045), Ms. Wiseman waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. In addition, a Conditional Cost Share Agreement for Extension of Sewer Main Line for the above referred to lots was submitted to the Board for approval. Therefore, Mr. Littrell made a motion that the Consent and the Conditional Cost Share Agreement for Extension of Sewer Main Line be approved. Mr. Inks seconded the motion which carried. APPROVE CONTRACTOR AND LICENSE PERMIT BONDS Mr. Anthony Molnar, Engineer, Division of Engineering, recommended that the following Contractors and Excavation Bonds be approved as follows: BOND OF CONTRACTOR D.J.'s Concrete Paul Hardrict Moore's Concrete LICENCE AND PERMIT BOND Wendy's of Fort Wayne, Inc. Effective May 15, 2002, Pursuant to Res. No.100-2000 Effective May 20, 2002, Pursuant to Res. No. 100-2000 Approved Effective May 20, 2002 Pursuant to Res. No. 100-2000 Effective May 23, 2002 Mr. Littrell made a motion that the recommendation be accepted and that the Bonds be approved as outlined above. Mr. Inks seconded the motion which carried. APPROVAL OF AUTHORIZATION FOR ENTRY UPON PUBLIC PROPERTY - WESTERN AVENUE - ARK ENGINEERING Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the Authorization for Entry Upon Public Property for drilling purposes, as submitted by Ark Engineering, was approved.
