The following comments and recommendations were submitted: <br />Community Investment and Engineering stated the vacation request violates the criteria of IC <br />36-7-3-13. The vacation would hinder the growth or orderly development of the unit or <br />neighborhood in which it is located or to which it is contiguous. The vacation would make access <br />to the lands of the aggrieved person by means of public way difficult or inconvenient. The <br />vacation would not hinder the public’s access to a church, school or other public building or <br />place. The vacation would hinder the use of a public right of way by the neighborhood in which <br />it is located or to which it is contiguous and would create a dead end for the remaining <br />North/South alley coming down from St. Vincent. <br />Therefore, the Board of Public Works submitted an unfavorable recommendation for the <br />vacation of this alley. The Board noted Engineering suggested the Street Department could be <br />asked to regrade the alley if it is a drainage issue, or the petitioner could petition to privately <br />pave the alley, noting there is precedent for this in alleys that tend to hold water. <br />Sincerely, <br />s/Linda M.
