JEFFERSON BOULEVARD SOUTH BEND, INDIANA 46601-1830 PHONE 574/ 235-9251 FAX 574/ 235-9171 CITY OF SOUTH BEND JAMES MUELLER, MAYOR BOARD OF PUBLIC WORKS November 10, 2020 Mr. Roger Woodard and Mr. Mark Hubbard dickn@sni-law.com RE: Alley Vacation – First East/West Alley between St. Vincent St. and Howard St. from St. Louis Blvd. to First North/South Alley (Preliminary Review) Dear Mr. Woodard and Mr. Hubbard: The Board of Public Works, at its November 10, 2020, meeting, reviewed comments by the Engineering Division, Community Investment, Fire Department, Police Department, and the Solid Waste Division. The following comments and recommendations were submitted: Community Investment and Engineering stated the vacation request violates the criteria of IC 36-7-3-13. The vacation would hinder the growth or orderly development of the unit or neighborhood in which it is located or to which it is contiguous. The vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient. The vacation would not hinder the public’s access to a church, school or other public building or place. The vacation would hinder the use of a public right of way by the neighborhood in which it is located or to which it is contiguous and would create a dead end for the remaining North/South alley coming down from St. Vincent. Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of this alley. The Board noted Engineering suggested the Street Department could be asked to regrade the alley if it is a drainage issue, or the petitioner could petition to privately pave the alley, noting there is precedent for this in alleys that tend to hold water.
