Indian~i (the "City ~) <br />and the City of South Rend. Indiana. Redcrclopment District (the "DisU~ict°), exists and operates <br />under the pro~~isions of Indiana Code ~ i6-7-1-1. as amended (lhe -'Act"). and <br />WHEREAS. the Commission, from time to time. has declared. confirmed and established <br />allocation areas for areas necdin~a redevclo~~mcnt and economic de~~clopment areas ~~'ithin the <br />District for purposes of tax increment {inancing pursuant to the Act: and <br />1~%HLREAS. Use Commission has fw-ther created ^Ilocation area funds for the pw~xue of <br />rccci~~ing tax increment financing rep enues recci~ al from the allocation areas: and <br />WHEREAS. there ha~~c been presented to the Commission Resolutions \o. ?~>? through <br />~~41 appropriating the t~unds from carious allucati~nas areas of the District (cullccti~cly. the <br />"Resolutions~~): and <br />WHL- REAS. the Commission desires to appropriate the allocation area funds to pay certain <br />expenses incurs{ by it or the City fbr local public impro~~ements that arc in or sen~in~ their <br />respecti~~c allocation areas. lr~hich appropriations arc set forth in more detail in the Resolutions and <br />WHEREAS. such appropriations arc subject to the pru~~isions of Indiana Cudc ~ 6-l . l -I 8-~: <br />and <br />WHEREAS. the proposed t~ppropriatiuns arc not for the operating expenses of the <br />Commission: and <br />\OW.THEREF(~RE.
