RESOLUTION NO. 2520 A RESOLUTION OF'CHE SOUTH BEND REDEVELOPMENT COMMISSION RELATED TO ACQUISI"PION OF PROPERTY IN THE AIRPORT ECONOMIC DEVELOPMENT AREA WHEREAS, under the authority granted by Indiana Code ~ ~6-7-14, c'! .cc~c/. and in furtherance of the Airport Economic Development Arca Plan ("Plan"), the South Bend Redc~elopment Commission (°Conunissiun') has determined that it is necessary to acquire unencumbered fee simple interest in certain property located within the area heretofore designated as the Airport Economic Development Arca (the "Area~~) ~a~ithin the City of South Bcnd, Indiana (the "Citv'~), ~~hich property is more particularly described at Exhibit A attached hereto and incorporated herein (~~Propert~ "); and WHEREAS, on June ?5, 200. the Commission adopted Resolution V'o. ?455 amending the Plan and adding the Property to the Arca~s acquisition list: and WHEREAS, rivo (2) independent appraisals of the Property have been obtained in accordance with Indiana Code ~ 3G-7- 14-19(b), ~~~hich provide an offering price of b26.000.00 (the "Olferin~~ Price"): and WHEREAS, the Commission now desires to authorise its authorized agents. hired fi~~r such proposes, or the staff of the Commission to provide and negotiate an offer t~~r the Purchase of the Property in accordance with Indiana Code ti dG-7-14-19, whid~ may include relocation costs and the Commissions payment of expenses incidental to the conveyance and determination ofthe tiflc ot~thc Propcrty_ and WHEREAS, the Commission finds that all procedm~cs nccessaiy for authorizing and acquiring the Propcrty ha~~e been completed in accordance with lndiana la~~~: NO~~', THEREFORE, BE IT RESOLVED by the South Bend Rcdc~~elopmcnt Conunission that: l . Authorized agents of the Commission and the staff' of the Commission are hereby authorized and directed to cause a purchase offer to be made in writing to the owner(s) of the Property as described at Exhibit A at the Offering Price (the "n~~era~~c Acquisition Price ~ in L-ahibit ~~) in accordance with Indiana Code ~ ~G 7-14-19, which offer or process may include relocation costs and the payment of expenses incidental to the conveyance and determination of the title of the Propcrty. ?. I~he Commissions agents and uttorncys are hereby authorized and directed to negotiate and prepare documentation ^ecessary to accomplish the acquisition of the Propcrty in accordance ~~~ith this Resolution and in a form acceptable to legal counsel.
