RESOLE"PION NO. 25l 1 A RESOLG'i'ION OF THE SOUTH BEND REDEVELOPMENT COMMISSION RELA"CED TO ACQCIS17~lON OF PROPERTY IN THG AIRPOR"I' ECONOMIC DEVELOPI9ENT AREA W'HGREAS, under the authority granted by Indiana Code ~ ,G-7-14. e[ src~. and in furtherance o1 the Airport Economic De~efopment Area Plan ("Plan), the South Bend Rede~clopment Commission ("Conu»ission'~) has determined that it is necessary to acquire unencumbered fee simple interest in certain property located ~~ithin the area heretofore designated as the F\irport Economic De~~elopu~ent Area (the "/1rea~~) ~~~ithin the City of South Bend. Indiana (the "Cit~~~) ~~~hich property is more particularly dcscribcd at Exhibit A attached hereto and incorporated herein ("Properl~~~~): and WHEREAS, on lure 1 ~. ?00~, the Commission adopted Resolution No. ?455 amending the Pla^ and adding the Property to the ~1rca~s acquisition list and WHEREAS, h~~o (?) independent appraisals of the Property ha~~c been obtained in accordance ~a~ith Indiana Code ~ 36-7-14-19(b), which pro~~ide an offering price of S?S.S50.O0 (the "<)fl~rin~~ Pricc~~): and ~~'HEREAS, the Commission no~~° desires to authorize its authorized agents, hired frn such purposes. or the staff of the Commission to provide and negotiate an oficr for the Purchase of the Property in accordance with Indiana Code ~ 36-7-14-19. ~~~hich may include relocation costs and the Commissions pay meat of c~pcnscs incidental to the conrcvnncc and determination of the title of the Property: and ~'HEREAS. the Commission finds that all procedures necessary for authorizing and acquiring the Property ha~~e been completed in accordance ~~~ith Indiana la~~~: NO~'~', THEREFORE, BE IT RESOD"EU b} the South Bend Rcde~~clopmcnt Commission that: 1 . Authorized a~,ents of the Commission and the staff of the Commission arc hercbv authorized and directed to cause a purchase offer to be made in writing to the o~~°ner(s) of the Property as dcscribcd at Exhibit A at the Offcriug Price (the °n~~era~~c l~cquisition Price~~ in l~.zhibit ~'1) in accordance ~~~ith Indiana Codc ~ ~6-7 14-19. ~~~hich offer or process may include relocation costs and the payment of espcnses incidental to the com~cyance and determination of the title of the Propert}~. ?. l~he Commissions a~~cnts and attorneys arc hereb~~ authorized and directed to negotiate and prepare documentation necessary to accomplish the acquisition of the Property in accordance ~~~ith this Resolution and in a form acceptable to Icgal counsel.
