Resolution No. 2497 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE SOUTH BEND REDEVELOPMENT AUTHORITY WHF.RLAS, the South Bend Redevelopment Authority (the "Authority") is the owner of a parcel of real property ("Real Property") situated in St. Joseph County, Indiana, more particularly described at Exhibit `A "attached hereto and incorporated herein; and WHEREAS, the South Bend Redevelopment Commission ("Commission") is the Lessee of the Real Property pursuant to that certain Lease Betmeen South Bend Redevelopment Authority and Soieth Bend Redevelopment Commission, dated November 1, 1993 and recorded in the Office of the Recorder of St. Joseph County, Indiana on December 14, 1993 as InstrumcntNo. 9~ 51906 ("Lease"); and WHEREAS, pursuant to LC. 36-7-14.5-12, the Authority may dispose of real property; and WHEREAS, the Authority desires to transfer the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment in order that it be sold and developed; and WHEREAS, the City of South Bcnd, Department of Redevelopment, acting by and through its governing body, the South Bend Redevelopment Commission desires to acquire the Real Property Isom the Authority; and WIIEREAS, pursuant to LC. 36-1-11-8, the Authority may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Authority, at its meeting of August 20, 2008 adopted its Resolution I~[o. 171, approving the transfer of the Real Property to the City of South Bend, for the use and benefit of its Department of Redevelopment. NOW, THEREFORE, F3E 1'T RESOLVED BY TI IE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: The transler of the Real Property situated in St. Joseph County, Indiana, and described on the attached Exhibit "A ", by the South Bend Redevelopment Authority to the City of South Fiend, for the use and benefit of its Department of Redevclopmcnt, shall be, and hereby is, accepted. 2. The Director of Redevelopment for the City of South Bend shall cause the recording of the quitclaim deed conveying all of the right, title and interest of the South Bend Redevelopment Authority in and to the Rcal Property to the City of South Fiend, for the use and benctlt of its Department of Redevclopmcnt.
