Return to: South Bend Redevelopment Commission 1400 S County -City Building South Bend, Indiana 46601 CERTIFICATE OF COMPLETION The City of South Bend, Indiana, Redevelopment Commission ( "Commission') certifies that on September 13, 2004, by Quit Claim Deed ( "Deed ") recorded on September 15, 2004, as Document Number 0445524 in the Office of the Recorder of St. Joseph County, Indiana, it conveyed to James and Sandra McCune ( "Developer ") the following described real estate ( "Property ") in the City of South Bend, St. Joseph County, Indiana: Lots Numbered Forty -five (45) through Forty -Seven (47) and the South Half of lot Numbered Forty -eight (48) as shown on the recorded Plat of South Bend City, a part of the City of South Bend, together with the West Half of the vacated alley lying East and adjacent to said lots. Pursuant to the covenants, conditions, restrictions and provisions of a Contract for Sale of Land for Private Development entered into by and between the Commission and the Developer ( "Contract ") dated August 20, 2004, and recorded on August 23, 2004, as Document Number 0441618 in the Office of the Recorder of St. Joseph County, Indiana, the Developer undertook to complete certain improvements on the Property conveyed by the Deed. The Developer has fully completed the improvements on the Property in accordance with the provisions of the Contract. This Certificate is issued January 16, 2014, and is evidence of the satisfaction and termination of the following covenants in the Contract and in the Deed: neither the Commission nor any other party shall hereafter have or be entitled to exercise any rights, remedies, or controls otherwise available with respect to the Property as a result of a default in or breach of any provisions of the Contract or the Deed by the Developer or any successor in interest or assign, unless: a. the Developer, any lessee, or any other successor in interest or assign defaults or breaches the covenants of Section VII (A)(2) of the Contract and b. the right, remedy or control relates to such default or breach.
