For all municipal business license questions, contact: City of South Bend • Department of Community Investment <br />227 West Jefferson Blvd • Suite 1400 S •South Bend, Indiana 46601 • 574.235.5912 • F: 574.235.9021 <br /> <br /> <br />LICENSE APPLICATION FOR – OPEN-AIR BUSINESS <br />MUNICIPAL CODE SECTION - 4-38 <br /> <br />DEFINITION: <br /> <br />An open air business includes any person who erects, places or stands in the city an open-air <br />booth, shed, tent, trailer, container, donation box or stand for the purpose of selling, bartering, <br />receiving for future sale or use, distributing or exchanging on or from such place any goods, <br />wares or merchandise, which terms shall include also all fruits, vegetables, country produce, <br />refreshments, beverages, baked goods, and confectionery. <br /> <br />NOTE: <br /> <br />The term "open-air business," as used in this section, does not include establishments which <br />are defined as itinerant restaurants under section 4-45 of this chapter. <br /> <br />GENERAL INSTRUCTIONS: <br /> <br />1. Print legibly and complete all sections to ensure efficient processing. <br />2. Assemble all required information and materials before filing application. <br />3. Thoroughly review all applicable Municipal Code Sections listed above. <br />4. Licenses expire January 31. <br />5. Add 10% to license fee for renewal after January 31. <br />6. Include $5.00 license application fee payable to City of South Bend. <br />7. License fee for donation boxes payable to City of South Bend due at issuance shall be $25.00 <br />per box per year. <br />8. License fee for any other open-air business conducted on private property shall be $45.00 <br />per location per year. <br />9. License fee for any other open-air business conducted on public property shall be $40.00 <br />per location per year. <br /> <br />NOTE: <br /> <br />1. No license shall be issued by the Controller under this section until the zoning, ingress and <br />egress of the location(s) have been approved by the appropriate City Department(s).
