RESOLUTION NO. 183 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY <br />GRANTING AN ELECTRIC UTILITY EASEMENT <br />TO INDIANA MICHIGAN POWER COMPANY <br />WHEREAS, the South Bend Redevelopment Authority (the "Authority") has been <br />created pursuant to Ind. Code § 36 -7 -14.5 (the "Act') as a separate body, corporate and politic, <br />and as an instrumentality of the City of South Bend, Indiana (the "City ") to finance local public <br />improvements for lease to the South Bend Redevelopment Commission (the "Commission ") on <br />behalf of the City of South Bend, Indiana, Department of Redevelopment; and <br />WHEREAS, the Authority holds title to certain properties within the Blackthorn Office <br />Park, including the lot commonly referred to as Lot 7A of the Blackthorn Office Park; and <br />WHEREAS, the Authority desires to authorize the grant of an electric utility easement <br />over and across said lot in favor of INDIANA MICHIGAN POWER COMPANY as set forth in <br />the "EASEMENT & RIGHT OF WAY" attached hereto and incorporated herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT AUTHORITY AS FOLLOWS: <br />1. The authority hereby grants and conveys an easement to INDIANA MICHIGAN <br />POWER COMPANY in the form of the "EASEMENT & RIGHT OF WAY" attached hereto and <br />authorizes the officers of the Authority to execute such documents, including the "EASEMENT <br />& RIGHT OF WAY" attached hereto, as may be necessary to complete the granting and <br />conveyance of said easement. <br />2.
