a RESOLUTION NO. 1 1 4 <br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY <br />APPROVING AN AMENDED AND RESTATED LEASE FOR CERTAIN LAND AND <br />PUBLIC IMPROVEMENTS BETWEEN THE SOUTH BEND REDEVELOPMENT <br />AUTHORITY, AS LESSOR, AND THE SOUTH BEND REDEVELOPMENT '~_--~'l <br />COMMISSION, AS LESSEE, APPROVING PRELIMINARY PLANS, <br />SPECIFICATIONS AND COST ESTIMATES FOR THE PROJECT <br />AND OTHER RELATED MATTERS <br />WHEREAS, the South Bend Redevelopment Authority (the "Authority") intends <br />to issue its South Bend Redevelopment Authority Lease Rental Revenue Bonds (the "Bonds") to <br />finance the acquisition, construction, renovation and equipping of the Morris Performing Arts <br />Center which includes the Morris Civic Center and certain portions of the building known as the <br />• Palais Royale (the "Palais Royale") located in South Bend, Indiana (the "Project"); and <br />WHEREAS, the preliminary plans, specifications and cost estimates for the Project <br />have been filed with the Authority and the Authority desires to approve them; and <br />WHEREAS, the Authority is currently leasing to the South Bend Redevelopment <br />Commission (the "Commission") the Palais Royale and the real estate upon which it is located <br />pursuant to a lease dated as of March 1, 1992, as amended by an Addendum to Lease dated as <br />of August 7, 1992 (collectively, the "Original Lease"); and <br />WHEREAS, the Authority desires to amend and restate the Original Lease by <br />entering into and adopting a proposed amended and restated lease to be dated as of May 1, 1997 <br />(the "Lease"), with the South Bend Redevelopment Commission (the "Commission") in the form <br />presented at this meeting, a copy of which is attached hereto as Exhibit A, for the purpose of <br />• <br />
