Resolution No.lUO <br />A RESOLIITION OF <br />THE SOIITH BEND REDEVELOPMENT AUTHORITY <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO THE CITY OF SOUTH BEND, INDIANA <br />FOR THE IISE AND BENEFIT OF ITS DEPARTMENT OF REDEVELOPMENT <br />WHEREAS, the South Bend Redevelopment Authority (the "Authority") is <br />the owner of the certain real property situated in St. Joseph County, <br />Indiana and being more particularly described at Exhibit "A," attached <br />hereto (the "Real Property") and; <br />WHEREAS, I.C. 36-7-14.5 governs the operations of the Authority but <br />fails to establish procedures governing the purchase and/or sale of real <br />property by the Authority; and <br />WHEREAS pursuant to its Resolution 33, adopted March 8, 1991, the <br />Authority determined to operate in accordance with the procedures set <br />forth at I.C. 36-1-11-8 with regard to the purchase and sale of real <br />property from or to another governmental entity; and <br />WHEREAS, the City of South Bend, Indiana, on behalf of its <br />Department of Redevelopment, acting by and through its governing body <br />the South Bend Redevelopment Commission ("Redevelopment"), desires to <br />acquire the Real Property; and <br />WHEREAS, the Authority desires to transfer title to the Real <br />Property to Redevelopment; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, Redevelopment may exchange or <br />transfer property with another governmental entity upon terms and <br />conditions agreed upon by the two (2) entities as evidenced by the <br />adoption of substantially identical resolutions of each entity. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />AUTHORITY AS FOLLOWS: <br />1. That the transfer of the Real Property situated in St. Joseph <br />County, Indiana, and more particularly at Exhibit "A," attached hereto <br />by the South Bend Redevelopment Authority to the South Bend, Indiana, <br />for the use and benefit of its Department of Redevelopment shall be, and <br />hereby is, approved, subject to the adoption by the South Bend <br />Redevelopment Commission of a resolution substantially similar in its <br />terms to the terms of this resolution. <br />2. That the President and Secretary, respectively of the <br />Authority, respectively, are authorized and directed to execute and <br />attest to the execution of a quitclaim deed conveying all of the right, <br />title and interest in and to the Real Property to the City of South Bend <br />for the use and benefit of its Department of Redevelopment <br />
