4$ RESOLUTION.. NO. A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY APPROVING AND ACCEPTING TRANSFER OF' REAL PROPERTY FROM THE ST. JOSEPH COUNTY AIRPORT AUTHORITY WHEREAS, the St. Joseph County Airpart Authority (hereinafter the "Airpart Authority"), a governmental entity, is the owner of a parcel situated in St. Joseph County, Indiana, and being of real property,. more particularly described as follows: Commencing at the southeast quarter of the southwest. quarter (1/4) of Section Twenty (20), Township Thirty Eight North (T38N), Range Two East. (R2E), thence north 00°19'53" west thirty feet. (30'), thence north 89°27'05" west thirty feet (30T) to the point of beginning: Thence in a northerly direction parallel to the north./south 1/4 section line-for Section 20, Township 38 North, Range 2 East a distance of two thousand one hundred forty-five feet (2,145') thence south. 89°49'35" east thirty-seven and five tenths feet (37,50, thence south 00°19`53" east eighty feet (gOT), thence south 89°40'07" west three and five tenths .feet (3.5`), thence south 44°40'07" west thirty five and thirty six hundredths feet (35.36'), thence due south parallel to the north-south 1/4 section line for Section 20, Township 38 North Range 2 East a distance of two thousand feet (2,000'), thence due west twenty feet (20') back to the point of beginning. (hereinafter referred to as the "Real Property"); and WHEREAS, I.C. 36-1-11-8 provides for between governmental entities by adoption resolutions; and the transfer of real property of substantially identical. WHEREAS, pursuant to I.C. 36-7-14.5-12(a)(5) and (4), the Redevelopment Authority may acquire and hold real property needed or considered useful in connection with local public improvements; and WHEREAS, pursuant to I.C. 8-22-3-10, the Airport Authority is authorized to acquire and dispose of real property for use or in connection with or for administrative purposes of the airport; and WHEREAS.,. the Airpart Authority is desirous of transferring title to the Real Property to the South Bend Redevelopment Authority (hereinafter, the "Redevelopment Authority") so that the same may be ,~' utilized. for the construction of Mayf lower Road; and WHEREAS, the Redevelopment Authority in orderoto allowgfor1thethe Real Property from the Airport Authors y construction of Mayflower Road.; and adopted March 8, 1991 ~ the WHEREAS, by Resolution No. 33 Redevelopment Authority has elected to abide by the provisions of I.C. 36-1-11-8 with regard to the transfer by or to it of real property to or from another governmental entity; and WHEREAS, the Airport Authority has or will adopt a resolution substantially identical to this Resolution to effectuate the transfer of the. Real Estate from the Airport Authority to the Redevelopment Authority. NpW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT AUTHORITY AS FOLLOWS:
