r <br /> Comm Wu Soot t: <br /> Public Works and Property Vacation Committee <br /> 'go Os Common tountti of he City of ffiouth g*nb: <br /> The January 8, 1996 meeting of the Public Works and Property Vacation Committee was <br /> called to order by its Chairperson, Council Member Dr.David Varner at 4:45 P.M. in the <br /> Council informal meeting room. <br /> Persons in attendance included Council Members: Varner, Luecke, Kelly, Zakrzewski, <br /> Broden, Washington, Hosinski, Coleman, and Pfeifer; John Oxian, Mr. William <br /> Wasienko, Gene Oakley, T. Brooks Bradamas, Don Porter, and Kathleen Cekanski- <br /> Farrand. <br /> Council Member Varner began the meeting by introducing members of his Committee <br /> which include himself as Chairperson, Council Member Zakrzew ski as Vice Chairperson, <br /> Council Member Cleo Washington and Council Member Charlotte Pfeifer. <br /> Council Member Varner noted that the first item on the agenda was to review substitute Bill <br /> No. 87-95 which is a proposed vacation of public property.He noted that he has reviewed <br /> all of the recommendations for the various agencies of the City and that the Board of Public <br /> Works has made a favorable recommendation with regard to the vacation. <br /> Mr.William Wasienko the attorney for the petitioner then made the presentation.He noted <br /> that the substitute Bill was necessary in order to provide proper notification to the property <br /> owner who resided in New York. Mr. Wasienko noted that the primary purpose for the <br /> proposed vacation would be to reduce the amount of vehicle traffic, to reduce the noise <br /> from vehicles and to reduce damage currently being caused by traffic and loitering in the <br /> area. <br /> Council Member Varner voiced concern with regard to the report from the Division of <br /> Engineering which noted that if the alleys are vacated that there would be no way for the <br /> property located at 1123 South Michigan Street to have access to the rear of the property for <br /> trash pick-up. Council Member Hosinski noted that he had received a call from Mr.Joseph <br /> Gorny however was unable to recontact him. Council Member Hosinski then left the <br /> meeting to make such a contact to see if it was related to the proposed vacation. <br /> Council Member Pfeifer voiced concern as to whether all of the property owners received <br /> proper notice. Mr. Wasienko noted that he delivered all of the envelopes and notices as <br /> required to the City Clerk's office. <br /> Upon his return, Council Member Hosinski noted that he was unsuccessful in contacting <br /> Mr. Gorny however he did note that Mr. Gorny was one of the property owners who <br /> signed in favor of the proposed vacation. <br /> Council Member Coleman then left the meeting to contact the Engineering Department with <br /> regard to the concerns raised by Council Member Varner. After discussion with the <br /> Engineering Department it was noted that the issue of whether the property is contiguous to <br /> the proposed vacation was properly satisfied. The Council Attorney summarized the <br /> provisions of the applicable state law found in Indiana Code Section 36-7-3-12. <br />
