aLanttit :Dr ErpnrI On At Mammon Mound! of* (lug of Onutfi iirnd: zoning and Vacation Committee The March 26 , 1984 meeting of the Zoning and Vacation Committee was called to order by its Chairman, Councilman John Voorde at 5 : 15 p.m. in the Council informal meeting room. Persons in attendance included: Councilmen Beck, Voorde, Puzzello, ' Paszek, Braboy, Zakrzewski, Serge, and Crone, Douglas Carpenter, Sheryl Els3e Bressler, Carol Sheetz, Dick Johnson, Richard Hill, Mrs . D.R. Johnson, Bonavia, Mary Varga, Dick Maginot, and Kathleen Cekanski-Farrand. Councilman Voorde noted that this meeting had been called to again review Bill No. 19-84 which would re-zone approximately 31 acres along State Road 23. He noted that both the staff and the Area Plan Commission gave favorable recommendation to the bill. He also noted that the Council held a public hearing on the bill on March 12th and continued discussion until this evening' s meeting.in the public portion. Mr. Hill then briefly summarized the history of this re-zoning. He noted that the bill would clarify zoning for existing businesses and that it would bring it to the status it had in July, 1980 . No structure could be higher than 3 stories with C Commercial and a residental buffer. He noted that the area was zoned A. Residential, A height in area when it was annexed into the City and that re-zonings thereafter were compatible. Dick Johnson of Area Plan stressed that zoning of the 31 acres must be kept completely separate from the Hilton Motel project. The re-zoning would not affect Hilton if they had certain vested rights. Certain areas would remain residential classification and if they are desired for a use which would be commercial they would have to petition for a re-zoning. Mrs. Dan R. Johnson expressed her concern about the proposed re-zoning, and thought it was like calling nuclear missiles "peacekeepers" . She noted that she lives on Harrington and that the City came to her neighborhood and asked them to drop their fight against annexation and the City would protect them. She stated that now their property taxes have doubled and that she believed the City had gone back on its promise. She and several residents have attended over 40 meetings without success. Three residences have already been torn down. Mr. Johnson reviewed the aerial photo and explained why he believed the proposed re-zoning represented the "highest and best use for the affected properties" . Councilman Voorde noted that the bill was initiated. by the Area Plan staff in an attempt to recognize the highest and best use. The effective date of the annexation was May 9 , 1980 and the former re zoning was done in July of 1980. Mrs. Elsie Bonavia did not want anything to go above 2 1/2 stories and did not want any large developments. Mrs. Crone asked if the area which was annexed came into the City A Residential and was informed that it was.
