Chodzinski <br />1212 Poplar St. <br />South Bend, IN 46628 <br />RE: Alley/Street Vacation – 1212 Poplar St., East/West Alley from Euclid Ave. to North/South <br />Alley between Euclid Ave. and Cleveland Ave. <br /> (Preliminary Review) <br />Dear Mr. Chodzinski: <br />The Board of Public Works, at its October 13, 2020, meeting, reviewed comments by the Engineering <br />Division, Community Investment, Fire Department, Police Department, and the Solid Waste Division. <br />The following comments and recommendations were submitted: <br />Community Investment stated the alley is not adjacent to the petitioner’s property, a requirement of IC <br />36-7-3-12 regarding the right to petition for the vacation of a public right-of-way. The Board also noted <br />that the vacation process closes the alley and divides the property between the adjacent property owners. <br />Since the petitioner is not an adjacent property owner, if the alley were vacated, the petitioner would no <br />longer be able to use it to access their garage which was the stated purpose of the vacation request. <br />Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of <br />this alley vacation. <br />Please contact Permit Department at (574) 235-9254 prior to picking up your radius map. You <br />will need a radius map showing properties within 150’ of the proposed vacation for your petition to the <br />Common Council.
