The following comments and recommendations were submitted:
Community Investment and Engineering stated the vacation request violates the criteria of IC
36-7-3-13. The vacation would hinder the growth or orderly development of the unit or
neighborhood in which it is located or to which it is contiguous. The vacation would make access
to the lands of the aggrieved person by means of public way difficult or inconvenient. The
vacation would not hinder the public’s access to a church, school or other public building or
place. The vacation would hinder the use of a public right of way by the neighborhood in which
it is located or to which it is contiguous and would create a dead end for the remaining
North/South alley coming down from St. Vincent.
Therefore, the Board of Public Works submitted an unfavorable recommendation for the
vacation of this alley. The Board noted Engineering suggested the Street Department could be
asked to regrade the alley if it is a drainage issue, or the petitioner could petition to privately
pave the alley, noting there is precedent for this in alleys that tend to hold water.
Sincerely,
s/Linda M. Martin, Clerk
