<br />RESOLUTION NO. 27- 2020 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />EXTENDING SIDEWALK CAFE PERMITS OPERATING PERIOD TO <br />DECEMBER 31 OF EACH CALENDAR YEAR <br />WHEREAS, Chapter 18, Article 1, Section 18-2 of the South Bend Municipal Code <br />provides the Board of Public Works with control and supervision of the streets and sidewalks <br />within the City; and <br />WHEREAS, Chapter 18, Article 1, Section 18-15 of the South Bend Municipal Code <br />authorizes the Board to issue permits for use of City sidewalks for outdoor cafes; and <br />WHEREAS, the current Board permit application limits operation of a sidewalk cafe to the <br />months of April 1 through October 31 of any given year; and <br />WHEREAS, the COVID-19 (coronavirus disease 2019) pandemic has had an adverse <br />economic impact on the City’s food service establishments; and <br />WHEREAS, to assist downtown restaurants with their recovery from the financial impact <br />of the pandemic, Downtown South Bend, Inc.(DTSB) requests that the Board of Public Work <br />extend the time period for operation of sidewalk cafes until December 31of each calendar year. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF PARK <br />COMMISSIONERS AS FOLLOWS: <br />1.The Board of Public Works extends the operation of outdoor cafes until December <br />31 of each calendar year. This extension applies to a 2020 sidewalk café application <br />as submitted to the Board of Public Works prior to the effective date of this <br />Resolution. Any application submitted following the effective date of this <br />Resolution, inclusive of those for additions, such as tents or other temporary <br />covered structures, requires additional approval from the City. <br />2.This Resolution shall be in full force and effect upon its adoption by the City of <br />South Bend Board of Public Works. <br />ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana <br />held on October 13, 2020, at 227 W.
