(, P �C4) <br />RESOLUTION NO. 3071 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />AUTHORIZING THE DIRECTOR OF REDEVELOPMENT TO APPROVE AND <br />CEC TE DOCUMENTS ON BEHALF OF THE CITY OF SOUTH BEND, INDIANA, <br />DEPARTMENT OF REDEVELOPMENTRELATED TO THE EXERCISE OF <br />JRC ASE OPTIONSIN THE BLACKTHORN CORPORATE OFFICE PARK AREA <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission ") is the <br />governing body of the City of South Bend Department of Redevelopment (the "Department ") <br />established under the Redevelopment of Cities and Towns Act of 1953, as amended, being <br />Indiana Code § 36- 7 -14 -1 et seq. (the "Act "); and <br />WHEREAS, the Commission is the owner certain parcels (the "Parcels ") located in and <br />around the Blackthorn Corporate Office Park ( "Blackthorn ") and the Commission has approved <br />and entered into an Option Contract (the "Agreement ") with Cressy and Everett Commercial <br />Company ( "Cressy "); and <br />HEREAS, the Agreement provides that Cressy has the option to purchase one or more <br />Parcels i1pon the terms and conditions set forth in the Agreement; and <br />HEREAS, in order to respond to development proposals made by third parties to <br />Cressy, t e Commission may be required to execute certain documents on short notice; and <br />WHEREAS, in order to provide the response time required by Cressy, the Commission <br />desires to expressly authorize the Director of Redevelopment for the Commission to approve and <br />execute such documents as necessary, including deeds and closing documents, to provide for the <br />transfer of a Parcel or Parcels to Cressy pursuant to the Agreement; <br />for the <br />OW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />"LOPMENT COMMISSION AS FOLLOWS: <br />1. The Director of Redevelopment of the Commission, Donald E. Inks, or his <br />(the "Director ") is hereby authorized to approve and execute, on behalf of the <br />>n, such documents as necessary, including deeds and closing documents, to provide <br />.sfer of a Parcel or Parcels to Cressy pursuant to the Agreement. <br />
