All members <br />present. <br />Deferred hearing had on resolution for the Vacation of <br />a ten fo&t alley lying north of dots 3and 4 in Ward's Sub -Division of lot 329 <br />and a part of lot 328 in Cottrell's First Addition, under Vacation Resolution No. <br />71. In the City of South Bend, Indiana. <br />In the above matter remonstratore appeared and'i.amended <br />remonstra.nce`;filed by Johanna Humphrey, Leafy R. Smith and She man Metzger <br />filed February, 27th., 1923 was ready <br />The Board after hearing all interested parties modified <br />resolution by vacation said alley to a point 17,.5 feet east of the west line <br />of lot 3 and as modified declare the above described property in all things, <br />vacated and this resolution as modified in aTl things, ratified, confirmed and <br />approved. <br />And the Board now orders that a list or roll be prepared <br />of all owners or holders of property and of valuable interests therein sought tob <br />be tkkan or to be injuriously affected which list or roll shall also describe the <br />property beneficially affected. <br />. Mr. E. L. Mossey agreed to ,file a deed for a proper <br />turn at intersection of alleys. <br />. Deferred hearing h$d on resolution f©r the Opening of <br />an alley in Duh.abrs addition between Washington Avenue and Colfax Avenue under <br />Condemnation Resolution No.. In this matter property owners appeared but <br />this hearing deferred,until Wednesday March $th., 19 23 at 7�:15 P.M. <br />y Hearing had on resolution for the Change of I:ocation of'a <br />Part of Rose Street in. Portage Heights Addition; under OnMdennatten Resolution <br />No. 71. In the City of South Bend, Indiana. <br />In the above matter no remonstrators appeared and no remon <br />strances was filed. The Board therefore sistain all former action taken, and <br />declare the Bove described property in all things, condemned and appropriated <br />for public use and this resolution in all things, ratified, confirmed and aproved <br />The Board further ordered that the City Engineer be in- <br />structed to prepare a roll of all owners or holders of property and of valvbale <br />Interests therein sought to be taken or to be injuriously or beneifically <br />affected which list or roll shall also described the property benefi ially affect <br />affected and.show the awards of damages and assessments of benefits in the above <br />matter. <br />Boardordered deed of Indiana Title and Loan Company for a <br />part of Lots 27 and 26 Portage Heights Addition and approved under date of Dec. <br />12th.1, 1922 rejected as Engineer reports description is incorrect. <br />
