\i- ~ ~ t NOTICE OF PUBLIC HEARING NOTICE OF REDEVELOPMENT GENERAL FUND BUDGET HEARING SOUTH BEND REDEVELOPMENT C011MISSION The South Bend Redevelopment Commission hereby declare, that on Friday. October 1.2010, at 10:00am, a public hearing will be held in the Board of Public Works meeting room, 1308 County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana, concerning the following resolution determining to approve and revise a budget for the Redevelopment General Fund (fund 433) for fiscal year 2010, and appropriating funds for the same. Members of the public are cordial]_v invited to attend the hearing for the purposes of expressin<~ their views. RESOLLTION NO. 2760 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROPRIATING MONIES FROM THE REDEVELOPMENT GENERAL FUND (FUND 433) FOR THE PURPOSE OF PAYING FOR CERTAIN EaPENSES INCURRED BY THE REDEVELOPMENT COMMISSION WHEREAS, the Redevelopment General Fund-Fund 433 (the "General Fund") ~~~as established for the purpose of holding, among other things, certain miscellaneous revenue proceeds (the "Proceeds") received by the South Bend Redevelopment Commission (the "Commission") and WHEREAS, the Commission desires to engage outside legal counsel to assist the Commmission in its redevelopment efforts (the "Services''); and WHEREAS, there are insufficient funds available or prop ided for in the existing bud~~et and tai le~~_v which maybe applied to payment for the Services; and WHEREAS, the Commission desires to pay certain expenses incu~7-ed b}~ it out of the Proceeds: and WHEREAS, such appropriations are subject to the provisions of Indiana Code § 6-1.1-18-5; and WHEREAS, on April 23, 2010 the Commission adopted Resolution 2664 appropriating Fifteen Thousand and no/ 100 Dollars ($ 15,000.00) and on July 9, 2010 adopted Resolution 2703 appropriating an additional Fifteen Thousand and no/100 Dollars ($15,000.00) for purposes of paying the Services; and WHEREAS, the Commission on September 3, 2010 set a public hearing for October 1. 2010 at ]0:00 a.m. in the Board of Public Works Meeting Room_ 13'x' Floor. Count._-Cit~ Building. ~~7 ~y'est ,tefferson Boulevard, South Bend, Indiana 46601; and WHEREAS, the Secretary of the Commission has caused notice of said hearin~~ on ,aid appropriations to be published in accordance with law; and WHEREAS, the Commission held a public hearing on the proposed additional appropriation rni October 1, 2010 at 10:00 a.m. in the Board of Public Works Meeting Room, 1308 County-City Building, 2'' 7 West Jefferson Boulevard, South Bend, Indiana 46601 at which all taxpayers and interested persons had an opportunity to appear and express their views at to such additional appropriation, notice of which continued hearing was published in the South Bend Tribune and the Tri-Count News on September I0. 2010, in accordance with Indiana Code § 6-1.1-18-5 and Indiana Code ~ 5-31-2(b); NOW, THEREFORE. BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. The Commission hereby finds and confirms that there are insufficient funds available or prop ided for in the existing budget and tax levy which may be applied to the payment of the Ser~~ices.
