~~C~~ RESOLUTION N0.2662 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION SETTING A PUBLIC HEARING ON THE APPROPRIATION OF MONIES FROM THE REDEVELOPMENT GENERAL FUND (FUND 433) FOR THE PURPOSE OF PAYING FOR CERTAIN EXPENSES INCURRED BY THE REDEVELOPMENT COMMISSION WHEREAS, the Redevelopment General Fund-Fund 433 (the "General Fund") was established for the purpose of holding; among other things, certain miscellaneous revenue proceeds (the "Proceeds") received by the South Bend Redevelopment Commission (the "Commission"); and WHEREAS, the Commission desires to engage outside legal counsel to assist the Commission in its redevelopment efforts (the "Services"); and WHEREAS, there are insufficient funds available or provided for in the existing budget and tax levy which maybe applied to payment for the Services; and WHEREAS, the Commission desires to pay certain expenses incurred by it out of the Proceeds; and WHEREAS, such appropriations are subj ect to the provisions of Indiana Code § 6-1.1-18-5; and WHEREAS, the Commission desires to set a public hearing on the proposed additional appropriation for April 9, 2010 at 10:00 a.m. in the Board of Public Works Meeting Room, 13th Floor, County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601 and to authorize the Secretary of the Commission to duly publish notice of said hearing in accordance with Indiana Code § 6-1.1-18-5 and Indiana Code § 5-3-1-2(b); NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION AS FOLLOWS: 1. The Commission hereby finds that there are insufficient funds available or provided for in the existing budget and tax levy which maybe applied to the payment of the Services. 2. The Commission hereby approves the use of funds in the General Fund in an amount not to exceed Seventy Thousand and 00/100 Dollars ($70,000.00) for purposes of paying the Services and desires to appropriate the said funds for said purpose. 3. The Secretary of the Commission is hereby authorized and directed to take all necessary steps to obtain the approval of the expenditure of such funds and to appropriate such funds pursuant to Indiana Code § 6-1.1-18.5, includingpublication in accordance with Indiana Code §5-3-1 of notice of a hearing on the appropriation of such funds to beheld at 10:00 a.m., Friday, Apri19, 2010, in the Board of Public Works Meeting Room, 13th Floor, County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
