-__ ._-- <br />C ~ C 3) <br />RESOLUTION N0.2665 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />AUTHORIZING THE DIRECTOR OF REDEVELOPMENT TO APPROVE AND <br />EXECUTE CONTRACTS ON BEHALF OF THE CITY OF SOUTH BEND, INDIANA, <br />DEPARTMENT OF REDEVELOPMENT <br />RELATED TO THE OPERATION AND MAINTENANCE OF <br />BLACKTHORN GOLF COURSE <br />(2010) <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission") is the <br />governing body of the City of South Bend Department of Redevelopment (the "Department") <br />established under the Redevelopment of Cities and Towns Act of 1953, as amended, being <br />Indiana Code § 36-7-14-1 et seq. (the "Act"); and <br />WHEREAS, the Commission owns the Blackthorn Gold Course ("Blackthorn") and has <br />entered into a Management Agreement (the "Agreement") with Kitson & Partners (Club <br />Services), LLC (the "Manager"); and <br />WHEREAS, the Commission has reserved in the Agreement the right of approval in all <br />contracts for the maintenance and operation of Blackthorn being proposed by the Manager; and <br />WHEREAS, the Commission desires to expressly authorize the Director of <br />Redevelopment for the Commission to approve and execute such contracts as necessary to <br />provide for the proper maintenance and operation of Blackthorn; <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT COMMISSION AS FOLLOWS: <br />1. The Director of Redevelopment of the Commission, Donald- E. Inks, or his <br />successor (the "Director") is hereby authorized to approve and execute, on behalf of the <br />Commission, such contracts as necessary to provide for the proper maintenance and operation of <br />Blackthorn. <br />2. All such. contracts approved and executed by the Director must be reported to the <br />Commission at its next meeting after execution of such contract and such contracts shall be <br />subject to ratification by the Commission. <br />
